Subject: Bill 5 - Planning rules
Aloha council members,
Even though I had a discussion with planner Jeff Darrow regarding this bill, I remain confused and concerned that
there may be unintended consequences related to it. Will it, in fact, allow more public testimony or, by lack of clear
definitions, allow abuse of local law by development interests?
I understand that this bill is intended to allow more public input—longer than the 60-day period. Again, however,
I'm concerned that Bill 5 may be misinterpreted and have to be tested in court(i.e., the recent discrepancy regarding
mayoral appointments that don't appear to fit the criteria of the county charter. The law was tested and affirmed in
another case, but still plagues us as "To Be Determined". Meanwhile, we have two appointees—one already
confirmed who don't have the experience required in the charter and confirmed by the court.)
I appreciate Planning Director Yee's work on the public's behalf in his efforts to clarify law and confirm the public's
right to determine their land use destiny, and I hope that this bill will initiate the discussion it deserves. My concern is
that Bill 5 may not provide the clarity needed to avoid future lawsuits or loss of public input.

which we all depend.
