COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />71 21 <br />RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER <br />INTO AN AGREEMENT WITH THE STATE OF HAWAII PURSUANT TO <br />HRS 46-7, TO ACCEPT FUNDS AS A LOAN TO THE COUNTY OF <br />HAWAII <br />WHEREAS, on March 13, 2019, Resolution 91-19 was adopted by the Council to <br />enter into an agreement with the State of Hawaii to enable the County to receive a <br />$40,000,000 loan pursuant to House Bill No. 1180, House Draft 1; and <br />WHEREAS, the State of Hawaii has requested that a new resolution be <br />authorized allowing the County to receive the $40,000,000 loan pursuant to Session <br />Laws of Hawaii — Regular Session of 2020, Act 009; and <br />WHEREAS, this loan to the County is to provide matching funds to obtain non - <br />state funds, including federal funds, in order to provide relief, recovery, mitigation, and <br />remediation assistance for disaster damage, losses, and suffering caused by the <br />volcanic eruption that occurred between May 3 and August 7, 2018; and <br />WHEREAS, the Hawaii County Council recommends the acceptance of these <br />funds and requests that the State of Hawaii release the funds to the County of Hawaii; <br />and <br />WHEREAS, the County of Hawaii will report monthly expenditures to the State of <br />Hawaii Department of Budget and Finance; and <br />WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county <br />departments obtain the consent of the council to enter into agreements with the federal <br />or state governments respecting action to be taken pursuant to any of the powers <br />granted by law to furnish, expend, and receive any funds or other assistance in <br />connection with projects being or to be undertaken pursuant to those powers; now, <br />therefore, <br />
