RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAI‘I PURSUANT TO HRS 46-7, TO ACCEPT FUNDS AS A LOAN TO THE COUNTY OF HAWAI‘I
WHEREAS, on March 13, 2019, Resolution 91-19 was adopted by the Council to enter into an agreement with the State of Hawai‘i to enable the County to receive a $40,000,000 loan pursuant
to House Bill No. 1180, House Draft 1; and
WHEREAS, the State of Hawai‘i has requested that a new resolution be authorized allowing the County to receive the $40,000,000 loan pursuant to Session Laws of Hawai‘i – Regular Session
of 2020, Act 009; and
WHEREAS, this loan to the County is to provide matching funds to obtain non-state funds, including federal funds, in order to provide relief, recovery, mitigation, and remediation assistance
for disaster damage, losses, and suffering caused by the volcanic eruption that occurred between May 3 and August 7, 2018; and
WHEREAS, the Hawai‘i County Council recommends the acceptance of these funds and requests that the State of Hawai‘i release the funds to the County of Hawai‘i; and
WHEREAS, the County of Hawai‘i will report monthly expenditures to the State of Hawai‘i Department of Budget and Finance; and
WHEREAS, Hawai‘i Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant
to those powers; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I, in accordance with section 46-7, Hawai‘i Revised Statutes, that the Mayor of the County of Hawai‘i is authorized to execute, on
behalf of the County, an agreement and related documents with the State of Hawai‘i to enable the County to receive funds as specified above.
BE IT FURTHER RESOLVED that the County Clerk of the County of Hawai‘i shall transmit copies of this resolution to the Office of the Mayor and to the Finance Department.
