Re: Resolution 140-99 and Resolution 151-99
Having reviewed both resolutions, the following is submitted.
On October 14, 1999, the Council approved Resolution 151-99 requesting the
legislative auditor's office to perform a special study of the County's policy on lease
agreements with nonprofit organizations. The resolution provides that a detailed report be
submitted to the Council for review by February 15, 2000.
In approving Resolution 151-99, the Council seems to be indicating that they intend to
review the terms and conditions of existing leases and they may want to insure consistency
amongst all agreements. At this time it seems prudent that negotiations for the next 20-year
agreement with the East Hawaii Cultural Council be deferred until the Council has had the
opportunity to conclude its review of the detailed study scheduled for February 15, 2000.
The existing agreement with the East Hawaii Cultural Council expires on November 7, 2000
leaving adequate time for the development of new terms and conditions.
We trust that the our approach to both resolutions makes sense and meets with your
approval.
