Arakaki Hawaii County Council 25 Aupuni Street, Suite 209 Hilo, Hawaii 96720 Dear Councilman Arakaki: I am enclosing a letter from the finance director Mr. Harry Takahashi dated November 24, 1999. He responded to my letter of November 19, 1999. It is my understanding East Hawaii Cultural Center was specifically excluded from the Hawaii County Council resolution 151.99, in order not to delay our lease negotiations. We had several site inspections in the last ten days. An architect who represented himself as "from the county', inspected our bathrooms on November 26th with 2 days notice. Mr. Glen Taguchi accompanied by 2 other staff inspected our building for several hours on December 1, 1999. We were not informed as to the reason for the inspection nor were we assured we would get a copy of the inspection report. Even though they did not discuss much of their findings with us we observed they noted some of the deficiencies that are inherent in an old building. Today we were informed by Mr. Norman Olesen that we are not ADA ( Americans with Disabilities Act) compliant and that he was passing this information to Mayor Yamashiro. We were told by Mr. Olesen the Mayor could shut us down on the basis of his report. He summoned us to his office to give us the enclosed information. We were told if the East Hawaii Guttural Council does the repairs, Mr. Olesen would want to know where the money is coming from and show proof that we have the money. The Self-Evaluation and Transition Plan addresses the accessibility infractions at facilities, recreational areas, and county parks under the jurisdiction of the County of Hawaii. This undertaking was prepared in accordance with the requirements of the Americans with Disabilities (ADA) -Title II and the Department of Justice implementing regulations at 28 C.F.R. 35.105(a) and 35.150(d) including the requirements regarding public input. Sudha Achar, M.D. Chairperson East Hawaii Cultural Center P O Box1312 Hilo, Hawaii 96721 Thank you for your letter, dated, November 19, 1999 expressing the East Hawaii Cultural Council's desire to initiate discussions on the terms of a new agreement for the East Hawaii Cultural Center. In reviewing the actions of the County Council, they approved Resolution 151-99 on October 14, 1999 request~~nq Inc legislative auditor to conduct a special study on terms and conditions included in existing lease agreements with nonprofit organizations. ~Ne believe that the County Council intends to review the terms and conditions and may want to standardize the requirements in all agreements. While we can understand your eagerness to nego; new terms and conditions, it seems very premature to initiate discussions till we can ascertain the c!i~ec~c of the County Council. A review of the existing agreement indicates that termination is November ; r'~; ,vhich provides us ample time to see what the Council does with the study results. To start some of the preliminary work, we take this means to inform you that we plan to conduct an inspection of the facility.
