Section 19-89.5 Kuleana land exemptions.
(a) For the purposes of this section, "kuleana land" means those lands granted to
native tenants pursuant to L.1850, p. 202, entitled "An Act confirming Certain Resolutions
of the King and Privy Council, Passed on the 21st Day of December, A.D. 1849, Granting to
the Common People Allodial Titles for Their Own Lands and House Lots, and Certain
Other Privileges," as amended by L. 1851, p. 98, entitled "an Act to Amend An Act
Granting to the Common People Allodial Titles for Their Own Lands and House Lots, and
Certain Other Privileges" and as further amended by subsequent legislation.
(b) Those portions of real property zoned as residential or agricultural, and designated
as kuleana land, shall pay the minimum real property tax set forth in subsection 19-90(g)
aslong as thereal_property is owned in whole or in part by.a lineal descendant of the
person(s) that received the original title to the kuleana land.
- (c) An application for`this exemption'shall be filed with the director on forms
prescribed by the director. The application shall include documents verifying ownership
of the portion of the parcel and that the condition set forth in subsection (b) has been
satisfied. Verification of the condition set forth in subsection (b) shall be satisfied by
either genealogy verification by the Office of Hawaiian Affairs or.by court order stating that
the applicant is a lineal descendant of the person(s) that received the original title to the
kuleana land. The applicant/landowner shall be responsible for all costs.

As a professor of international law, the former Secretary of the UN Human Rights Committee,
co-author of book, The United Nations Human Rights Committee Case Law 1977-2008, and
currently serving as the UN Independent Expert on the promotion of a democratic and
equitable international order,1 have come to understand that the-lawful politicarStatus of the
'Hawaiian Islands is that of aasoveieign nation states-in continuity;but a nation state that is

Hawaiian Islands must be..administered by`tire application of the laws of the occupied state

Based on that understanding, in paragraph 69(n)of my 2013 report(A/68/284)to the United
Nations General Assembly I recommended that the people of the Hawaiian Islands—and
other peoples and nations in similar situations—be provided access to UN procedures and
mechanisms in order to exercise their rights protected under international law. The
adjudication of land transactions in the Hawaiian Islands would likewise be a matter of I
Hawaiian Kingdom law and international law, not domestic U.S. law.
I have reviewed the complaint submitted in 2017 by Mine Routh Bolomet to the United
Nations Office-of the High Commissioner for-Human Rights pointing-out histor-ical-and)
ongoing plundering:ofthe Hawaiians'°.lands,particularly of those heirs and descendants with'
land titles that originate.from.the.distributions`of lands under the authority of gig Hawaiian,
. ' Kingdom,'Pursuant to the U.S. Supreme Court judgment in the Paquete Habana Case (1900),

U.S. courts have to take international law and customary international law into account in
property disputes. The state of Hawaii courts should not lend themselves to a flagrant
violation of the rights of the land title holders and in consequence of pertinent international
norms.Therefore, the courts of the State of Hawaii must not enable or collude in the
wrongful taking of private lands,bearing in mind that the right to property is recognized not
only in U.S. law but also in Article 17 of the Universal Declaration of Human Rights,
adopted under the leadership of Eleanor Roosevelt.

SUBJECT: COUNTY OF MAUI'S ROLE IN LAND DISPUTES AND
OTHER RACIALLY SENSTIVE CONFLICTS
First and foremost, thank you for your service to the people of Maui
County. I know your job, and the job of all our law enforcement officers, is not
an easy one. As many parts of the United States grapple with questions of social
justice and systemic racism, brought forth most recently by the Black Lives
Matter movement, it is pressed upon us, here in Hawaii, to face endemic
institutional racism that can, be traced back to the illegal overthrow of the
Hawaiian Kingdom.
To this day, Kana.ka Maoli continue to face systemic oppression, as
witnessed in Bank of America's refusal to fulfill loan commitments to Filipinos
and Kanaka Maoli and the continued struggle for Kanaka families as they defend
their Kuleana lands against quiet title actions. For example, recently in a jury
trial, Maui resident Ke`eaumoku Kapu won his family lands back from a
prominent West Maui developer after over fifteen years of waiting on the court
docket.

Disputes over Kuleana lands are especially sensitive considering the
history of Hawaii and the intrinsic tie Kanaka Maoli have to the `aina. Cases and
requests for clarity over land title continue to surface all throughout the County
of Maui. Recently, I have been made aware of several disputes over land that has
no history of property tax records prior to the last five years or so.
That being said, I would like to respectfully inquire as to the Maui Police
Department's involvement in such disputes. I hope that bringing these questions
forward may bring some much needed clarification to all parties involved.
When a court has not made a legal determination as to the true owners of
a particular parcel of land, under what circumstances will a police
officer intervene in a dispute among claimants and orderone or more
claimants to leave the land?
What are the standards the police use to evaluate and determine which
claimant to a particular parcel of land in dispute should be supported
or assisted?
When did the department change from its previous policy of refraining
from getting involved in disputes regarding real property ownership --
where a court has not made a final legal determination as to the true
owners?
What is the department doing to mitigate concerns about increased exposure
to legal liability or diminution of public respect by getting involved in real property
disputes before a final determination has been made by the appropriate court of
law?
What actions would be required for members of law enforcement to enroll in
the same Native Hawaiian Law training that our boards and commissions
members are required to take? Would it be possible to enroll key officers who could
then share the knowledge and documents they acquired during the training with
the rest of the police force?
Given the broken-title history of land ownership throughout Maui County,
and the State of Hawaii, I find it necessary to clarify the role law enforcement
plays in the handling of such civil matters. As these disputes continue to occur
in Kaua`ula, Kahoma, Hali`imaile, Kiipahulu, and other locations throughout the
County, the public would benefit from answers to these questions as soon as
possible.
