On behalf of the Queen Liliuokalani Village Community Association (the "Association"),
thank you for taking the time to consider the above-referenced matter. I have received
correspondence from Lorraine Acdal of your committee advising• that the matter will be
addressed at your upcoming meeting in Hilo on Wednesday, October 13, 1999 at 9:00 a.m.
Unfortunately, I will not be able to attend this meeting. However, Board member Ruth
Edwards plans to attend on behalf of the Association, along with Don McIntosh, the surveyor
assisting the Association with its consolidation and resubdivision project. Mr. McIntosh will be
able to provide valuable information on the history and status of the consolidation and
resubdivision project, while Ms. Edwards will try to assist with the discussion of the sewer
assessment situation.
It is sincerely hoped that the Committee will be able to arrange for the holding of a public
heazing on these matters in Kona in the near future. Most of the homeowners within Queen
Liliuokalani Village are simply unable io beaz the time and expense necessary to attend meetings
in Hilo, although many would no doubt like the opportunity to participate in the process of
seeking a successful solution to the current situation. An actual visit to the subdivision is also
highly encouraged, so that decisiotunakers can see firsthand the challenges facing the
Association and its members.
With the Wastewater Division continuing to assess the owners for sewer charges, the
resolution of this issue appears to require the more immediate attention. The Association has
~ ~ ~ ~ explored other avenues to address the situation, but, due in part to economic constraints, a
z g "legislative" solution obtained through the assistance of your Committee and the Council is
° z preferred. Enclosed is a copy of a memorandum dated September 10, 1999 to the Board of
P Directors of the Association from this firm detailing the difficulties and expense involved in
~y I ~ ~ attempting to address the problem via declaratory relief and/or litigation.
