RE: Draft 2 of Resolution to Appoint the County Auditor
Please find attached Draft 2 of Resolution 98-21 to appoint the County Auditor pursuant to Section 3-18
of the Hawai`i County Charter. Below are the amendments to Resolution 98-21,which were duly
approved by the Council on April 21, 2021.
1. The Enacting Clause was amended with the contents of Communication 208.1 to read as follows:
"BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that[ ]
Mr. Tyler Benner is hereby appointed as County Auditor pursuant to Section 3-18(a) of the Hawai`i
County Charter(2020)."
2. The Be It Further Resolved clause was amended by verbal floor amendment to change the effect date
of its appointment to July 1, 2021 to read as follows:
"BE IT FURTHER RESOLVED that this appointment shall take effect on [fie] July 1,
2021, and shall remain in effect for six years, and thereafter, until a successor is appointed."
The Council suspended Rule No. 24(1)(e),which requires the holdover of a substantively amended
resolution, and adopted Resolution No. 98-21,Draft 2.
