Arakaki, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki and Members: Change of Zone Application (REZ 94-2) Applicant: Dorothy Souza Request: A-Sa to A-2a Tax Man Kev: 4-5-3:24 and 124 The Planning Commission, after a duly held public hearing on January 16, 1997, voted [o recommend for your approval the proposed legislative bill to change the district classification for approximately 13.67± acres of land from Agricultural (A-Sa) to Agricultural (A-2a). The property is located on the mauka side (southeast corner) of the Mamalahoa Highway at its intersection with Loke Street at Kaao Homesteads, Honokaa, Hamakua, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time and stage developments to achieve quality growth determined by the General Plan and related planning documents. The implications of these evaluations and decisions must also be considered as they may have an impact on other similar areas in the County. Honorable James Y. Arakaki, Chairman and Members of the County Council Page 2 The proposed Change of Zone from an Agricultural (A-5a) to Agricultural (A-2a) zoned district would conform to the following goals, policies and standards of the Land Use and Agriculture Elements of the General Plan: * Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural and physical environments of the County. * Zone urban- and rural-types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. * Allocate appropriate requested zoning in accordance with [he existing or projected needs of neighborhood, community, region and County. * Rural-style residential-agricultural developments, such as new small-scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations. * The County shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. * Zoning requests shall be reviewed with respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zoned uses, availability of public services and utilities, access and public need. The Land Use Pattern Allocation Guide (LUPAG) Map component of the General Plan is a representation of the document's goals, policies, standards and courses of action to guide the coordinated growth and development of the County. It reflects a graphic depiction of the physical relationships among [he various land uses. The LUPAG Map establishes the basic urban and non-urban land use pattern for areas within the County. The proposed Change of Zone request conforms to the LUPAG Map, which designates the area for Low Density Urban Development. Such a designation may allow for single family residential in character, ancillary community and public uses and convenience type commercial uses. The requested Agricultural (A-2a) designation would allow the applicant to transfer ownership of each parcel to her five children. The project area may be utilized for residential, agricultural and related uses in a manner which would not be contrary to the uses permitted within an area designated for Low Density Urban. Honorable James Y. Arakaki, Chairman and Members of the County Council Page 3 The project area is situated within the State Land Use Rural District. In April 1993, the State Land Use District for the project area was amended from Urban to Rural. The applicant requested the land use change in order to dedicate the project area for agricultural uses. The applicant is requesting for an A-2a zone designation in order to transfer ownership of each parcel to her five children. However, each agricultural lot would still provide for any potential to establish residential and/or agricultural opportunities which is consistent with [he requirements of Chapter 205, Hawaii Revised Statutes, otherwise known as the State Land Use Law. The Land Study Bureau's Overall Master Productivity Rating of the project area is "C" or Fair productivity potential for most agricultural uses. The Agricultural Lands of Importance to the State of Hawaii (ALISH) Map system classifies the project area as "Prime Agricultural Land." The land is currently utilized for cattle pasture and macadamia nut productivity. As previously stated, the applicant intends to develop the project area into a total of five (5) agricultural lots having a minimum lot size of 2 acres. Such development would allow the applicant to convey the individual lots to her children for residential and/or agricultural purposes. The Northeast Hawaii Community Development Plan (CDP), adopted in June, 1979 (Ordinance No. 445), reflects the area as outside of the CDP study boundaries. The project site is located approximately one-half mile to the southwest of Honokaa Town. Primary access will be from the Hawaii Belt Road and onto Loke Street (Apua Road), which has a 30-foot right-of-way with 10-foot wide pavement, approximately 120 linear feet from the Hawaii Belt Road. According to the Department of Public Works, Loke Street is an abandoned State homestead road which the County does not own nor maintain. In addition, said agency recommends that the roadway be improved for any proposed additional accesses onto Loke Street. All roadway improvements to the project area will be constructed in accordance with the Department of Public Works. Roadway improvements at the intersection of the Hawaii Belt Road and Loke Street would be constructed, if applicable, in accordance with the State Department of Transportation. According to the Department of Water Supply, water can be made available to only the existing three lots of record. There is no municipal sewer system in the area. Therefore, wastewater generated by [he proposed subdivision is proposed to be handled by means of individual cesspools or septic tanks meeting with the Department of Health. Solid waste generated by the development would be collected and disposed in compliance with applicable Federal, State and County rules and regulations. All other essential utilities or services are or will be made available to the project site. Honorable James Y. Arakaki, Chairman and Members of the County Council Page 4 The project site has no severe topographic or geologic problems which cannot be properly rectified or which would render the land unusable for the proposed agricultural use. The project area had been extensively altered from the previous sugarcane cultivation and the present uses are cattle pasture and macadamia nut productivity. Therefore, significant archaeological sites are not anticipated to be located within the project area. Similarly, the project area is not considered a habitat for rare or endangered species of plants or animals. For your favorable consideration, an amendment to Section 25-8-17, the Haina-Honokaa-Kukuihaele Zone Map, of the County Zoning Code is transmitted. Souza, the landowner of the property. LOCATION AND OWNERSHIP The property is approximately 13 acres, located at Kaao Homesteads, Hamakua District TMK: 4-5-03-24~~2./{. The above subject parcel, consisting of 13.656 acres, is in fact, three separate lots of record. Lot 1, consisting of 18,068 square feet, received final subdivision approval from the County of Hawaii on January 3, 1962. The remaining Lot 2, is divided by an abandoned ditch right- of-way being in separate ownership at one time. Therefore, Lot 2 is divided into Lots 2A and 2B. This corner site is located on the mauka side of the Hawaii Belt Road between Kahaupu Gulch on the south side and Loke Street "Apua Road" on the north side. The applicant owns the property in fee simple and wishes to continue leasing the land to her son Clifford D. Souza for cattle grazing and mac nut production. PROPOSED USE Due to the advance age of the applicant she wishes to change the zoning so she can subdivide the land. She can then tranfer ownership to each of her five children. The land will continue to be leased to her son for agriculture use. ROADS AND TRAFFIC The primary vehicular access to the property will be from the Belt Highway on the existing paved road. Traffic into and out will not increase due to no change in use of the property. POLICE AND FIRE PROTECTION The area is provided police protection services by the Honokaa Police Station. The Honokaa Fire and Rescue Station provides emergency services for the Honokaa community. 1 WATER The property is supplied by the county water system. GENERAL PLAN AND ZONING The applicable land use designations for the property are as follows: State Land Use District: Rural Zoning: SA General Plan: Low Density/Alternate Urban REASON FOR ZONE CHANGE Due to the high cost of land in Hawaii and the advanced age of applicant, she wishes to obtain anZ A zoning so the land can be divided into 5 lots. This will enable applicant to give her five children, 5 separate lots. Previous to this year the LUC designated the property as urban. The applicant until this year has paid high taxes based on the urban classification without the benifit of dividing the land because of the SA zoning. This year a request was made and granted from the LUC to change the classification to rural. Presently there is 3 separate lots and the zoning change will enable the applicant to create 2 more lots. The proposed use will not change the essential character of the land and the present use. The caneland to the south will become fallow after Hamakua Sugar shuts down next year. These lands are zoned for alternate urban. The proposed zoning change will be in keeping with the General Plan which is low density. 2 FLORA/FAUNA The land was previously cleared for mac nuts and sugarcane. The existing vegetation is mac nuts, pasture grasses, and weeds. There are no endangered plant or animal species. OF ZONE APPLICATION 94-2 DOROTHY SOUZA has submitted an amended request for a Change of Zone for approximately 13.67± acres of land by changing the district classification from Agricultural (A-Sa) to Agricultural (A-2a). Originally, [he applicant requested a change of zone from A-Sa to A-la. The property is located on the mauka side (southeast corner) of the Mamalahoa Highway at its intersection with Loke Street at Kaao Homesteads, Honokaa, Hamakua, Hawaii, TMK: 4-5-3:24 and 124. GENERAL. INFORMATION 1. Landownership: The subject properties are owned by the applicant and consist of two separate parcels containing approximately .43 acre (Parcel 124) and 13.24 acres (Parcel 24). It should be noted that Parcel 24 has been determined that it has two (2) legal lots. 2. April 7, 1993: Effective date of Hawaii County Council's adoption of Ordinance No. 93-25 which amended the State Land Use District from Urban to Rural. The applicant requested the land use change in order to dedicate the project area for agricultural uses. Ordinance No. 93-25 was approved subject to the following conditions: "A. The applicant, successors or assigns shall be responsible for complying with all of the stated conditions of approval. "B. The applicant shall submit the proper application(s) for the dedication of the project site, in part or in whole, to the Department of Finance-Real Property Tax Division, within one year from the effective date of this boundary amendment. "C. Comply with all other applicable laws, rules, regulations and requirements. "D. An annual progress report shall be submitted to the Planning Director prior to the anniversary date of the effective date of the boundary amendment. The report shall address the status of the development and the compliance with the conditions of approval. This condition shall remain in effect until all of the conditions of approval have been complied and the Planning Director acknowledges that further reports are not required. "E. An extension of time for the performance of conditions within the ordinance may be granted by the Planning Director upon [he following circumstances: l) the non-performance is the result of conditions that could not have been foreseen or are beyond the control of the applicant, successors or assigns, and that are not [he result of their fault or negligence; 2) granting of the time extension would not be contrary to the State Land Use Law, Land Use Commission Rules, General Plan or the Zoning Code; 3) granting of the time extension would not be contrary [o the original reasons for the granting of the boundary amendment; 4) the time extension granted shall be for a period not to exceed the period originally granted for performance (i.e.. a condition to be performed within one year may be extended for up to one addition year); and 5) if the applicant should require an additional extension of time, the Planning Director shall submit the applicant's request to the County Council for appropriate action. Further, should any of the conditions not be met or substantially complied with in a timely fashion, the Director shall initiate a boundary amendment of the area to its original or more appropriate designation." 3. In August 1993: Petition to Dedicate Land for Agricultural Use was submitted by the applicant to the Real Property Tax Division in compliance with Condition B of Ordinance No. 93-25. According to the petition, Parcel 24, consisting of approximately 13.24 acres, would be dedicated for use as a cattle pasture. 4. February 22, 1994: The applicant submitted an application for a Change of Zone from A-Sa to A-la. 5. October 17, 1996: Letter from Planning Cotission to Hawaii County Council, forwarding an unfavorable recommendation on the Change of Zone request. (See Exhibit A) 6. October 8, 1996: Letter from applicant's son to County Council Planning Committee Chairman Takashi Domingo, informing that the applicant wishes to withdraw Bill No. 331 and amend her change of zone request from an A-Sa to A-2a rather than to an A-la zone designation. (See Exhibit B) -2- APPLICANT'S REQUEST 7. Request: The applicant is requesting a Change of Zone for approximately 13.67± acres of the land from an Agricultural-5 acres (A-Sa) to an Agricultural-2 acre (A-2a) in order to consolidate and resubdivide the project area into 5 parcels having a minimum lot size of 2 acres. Upon the receipt of Final Subdivision Approval, the applicant will then transfer ownership of the individual parcels to her 5 children. 8. Additional Information: In support of the request, the applicant submitted the change of zone application. (Exhibit C -Change of Zone Application) STATE AND COUNTY PLANS 9. Northeast Hawaii Community Development Plan: The project site is located outside of the study boundaries of the Northeast Hawaii CDP, adopted by the County Council by Ordinance No. 445 in June 1979. 12. Hamakua Regional Plan: The project site is located within a planning subzone (subzone 2) of the Hamakua Regional Plan, which was adopted by the County Council by Resolution No. 244-90 on November 8, 1990. The Plan recommends that the expansion of Honokaa town proceed in a northerly direction, away from the project site. 13. County Zoning: Agricultural-5 acres (A-Sa) 14. Subject Property: The project area is bordered by the Hawaii Belt Road to the north, Loke Street to the west and the Kahaupu Gulch running along its eastern boundary. Parcel 24 is currently maintained in approximately 12 acres for cattle pasture and one acre in macadamia nut orchard. 16. USDA Soil Survey Report: Soils located within the project area consist of Kukaiau Silty Clay Loam (I{uD). This soil consist of well-drained silty clay loams that formed in volcanic ash. In a representative profile, the surface layer is very dark grayish- brownsilty clay loam about 10 inches thick. The subsoil is dark-brown silty clay loam about 40 inches thick. These layers are underlain by basalt. This soil dehydrates irreversibly into aggregates the size of fine sand. Permeability is moderately rapid, runoff is slow and the erosion hazard is slight. This soil is used mostly for sugarcane. Small areas are used for truck crops, macadamia nuts and pasture. 17. Access: Access from the Hawaii Belt Road to the project site is via Loke Street (Apua Road), which has a 30-foot right-of--way with 10-foot wide pavement, approximately 120 linear feet from the Hawaii Belt Road. According to the Department of Public Works, Loke Street is an abandoned State homestead road which the County does not -4- own nor maintain. In addition, said agency recommends that the roadway be improved for any proposed additional accesses onto Loke Street. 23. Water: Parcel 124 is currently being serviced by the County's water system. According to the Department Water Supply, the three (3) existing lots may each have water service. However, the existing water system facilities cannot support the additional lots. Water for the entire project area is limited to one 5/8-inch meter and 600 gallons per day. 24. The property is located on the mauka side of the Mamalahoa Highway (Hawaii Belt Road) at its intersection with Loke Street, Kaao Homesteads, Honokaa, Hamakua, Hawaii. The denial recommendation was based on the following findings: In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. It is only through such a comprehensive policy analysis approach that evaluations and decisions can be made to better time or stage developments to achieve quality growth. The implications of these evaluations and decisions must also be considered as they may have an impact on other similar areas in the County. Thy requested change of zone to an Agricultural-1 acre (A-ia)-zoned district within this particular area of Honokaa will not conform to the following goals, policies and standards of the Land Use Element of the General Plan: -~9 Exhibit A Honorable Spencer K. Schutte, Chairman and Members of the County Council Page 2 o Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural, and physical environments of the County. o Zone urban- and rural-types of uses in areas with ease of access to community services and employment centers and with adequate public utilities and facilities. o Zoning request shall be reviewed with"respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zoned uses, availability of public services and utilities, access, and public need. o The county shall encourage the maintenance of communities meeting the needs of its residents in balance with the physical and social environment. Approval of this request would also be in conflict with a policy of the Agricultural Element of the General Plan which recommends that "Rural-style residential-agricultural developments, such as new small-scale rural communities or extensions of existing rural communities, shall be encouraged in appropriate locations." It has been a long-established policy of the Planning Commission and the Planning Department that areas to be considered for rezoning have basic improvements and amenities necessary for immediate use. A most important amenity is the availability of a County-approved potable water supply to support the proposed use. The entire project site is currently serviced by a single water meter which is limited to 600 gallons per day. The Department of Water Supply has informed the Applicant and the Planning Department that the County's existing water system cannot support the proposed subdivision development at this time. Extensive improvements and additions to the County's existing water system are necessary before additional water commitments can be made available to the project site. Improvements and additions to source, storage, transmission, booster pump, and distribution facilities are required. The construction of a private water source is not being contemplated by tha Applicant. A favorable recommendation of the change of zone request could lead to the creation of up to 13 one-acre lots. Each of these lots could accommodate a single family dwelling and Ohana dwelling, if approved by the Planning Department. Imagine the severe limitations of having 13 to 26 single family residences Honorable Spencer K. A favorable recommendation of the request would place an extreme burden on the County to provide the necessary water system improvements in a timely manner. An additional concern regarding infrastructural deficiencies within the affected area is the substandard nature of Loke Street (Apua Road), which maintains a pavement width of approximately 10 feet within a 30-foot right-of-way. The existing pavement width of Loke Street would permit one-way traffic only. Chapter 23 of the Hawaii County Code (Subdivision Code) requires that roadways servicing an agricultural subdivision maintain a pavement width of 20 feet within a 50-foot right-of-way. Clearly, Loke Street would not be able to accommodate the traffic to be generated by the proposed development should this change of zone be approved and which may result in a hazardous situation as vehicles using Loke Street attempt to jockey for position along this narrow roadway. As required by the County Council, transmitted is a draft ordinance amending Section 25-98, the Haina-Honokaa-Kukuihaele Zone Map, of the County Zoning Code. "More than one fire apparatus road may be required when it is determined by the chief that access by a single road may be impaired by vehicle congestion, condition of terrain, climatic conditions or other factors that could limit access. "For high-piled combustible storage, see Section 81.109. "(c) Width. The unobstructed width of a fire apparatus access road shall meet the requirements of the appropriate county jurisdiction. "(d) Vertical Clearance. Fire apparatus access roads shall have an unobstructed vertical clearance of not less than 13 feet 6 inches. "EXCEPTION: Upon approval vertical clearance may be reduced, provided such reduction does not impair access by fire apparatus and approved signs are installed and maintained indicating the established vertical clearance. "(e) Permissible Hodifications. Vertical clearances or widths required by this section may be increased when, in the opinion of the chief, vertical clearances or widths are not adequate to provide fire apparatus access. "(f) Surface. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be provided with a surface so as to provide all- weather driving capabilities." (20 tons) "(g) Turning Radius. The turning radius of a fire apparatus access road shall be as approved by the chief." (45 feet) "(h) Turnarounds. All dead-end fire apparatus access roads in excess of 150 feet in length shall be provided with approved provisions for the turning around of fire apparatus. When a bridge is required to be used as access under this section, it shall be constructed and maintained in accordance with the applicable sections of the Building Code and using designed live loading sufficient to carry the imposed loads of fire apparatus. "(j) Grade. The gradient for a fire apparatus access road shall not exceed the maximum approved by the chief." (15$) "(k) Obstruction. The required width of any fire apparatus access road shall not be obstructed in any manner, including parking of vehicles. Minimum required widths and clearances established under this section shall be maintained at all times. "(1) Signs. When required by the fire chief, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction thereof or both." An approved water supply capable of supplying required fire flow for fire protection shall be provided to all premises upon which buildings or portions of-buildings are hereafter constructed, in accordance with the respective county water requirements. There shall be provided, when required by the chief, on-site fire hydrants and mains capable of supplying the required fire flow. "Water supply may consist of reservoirs, pressure tanks, elevated tanks, water mains or other fixed systems capable of providing the required fire flow. "The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be protected as set forth by the respective county water requirements. All hydrants shall be accessible to the fire department apparatus by roadways meeting the requirements of Section 10.207."
