No. 234/Bill No. 35 PLACE: Council Chambers Hilo, Hawaii TIME: 11:13 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 35, reports as follows: Bill No. 35 amends Ordinance No. 09-138 (REZ 09-000097)to reclassify lands from Single Family Residential-10,000 Square Feet(RS-10)to Industrial-Commercial Mixed-20,000 Square Feet(MCX-20) at Waiakea Houselots, Waiakea, South Hilo, Hawaii. Tax Map Key: 2-2- 035:034. The applicant is J.P. Automotive LLC (Formerly Conrad & Joanne Dakujaku). Bill No. 35 was introduced by Committee Chair Ashley Kierkiewicz by request. Planning Director Zendo Kern recused himself from this matter as the applicant was a client when he worked as a land use consultant. Deputy Director Jeff Darrow was present in the Hilo Chambers to answer questions on the bill. John Pipan, Consultant from Land Planning Hawaii, LLC, present via Zoom to represent the applicant. He shared that the applicant achieved numerous conditions of approval and that the applicant was requesting time extension to complete the project, which had already received final plan approval and financing. Committee Member Holeka Inaba noted that the language of Condition J stating the "unlikely event that surface or subsurface historic resources..." should not include the word"unlikely" as it gives the perception that there is not enough caution being taken. He also noted that the word "shall" should be included before "cease work."Deputy Director Darrow did not object to the suggestions and noted that the Planning Department would include these changes in future bills. Committee Chair Kierkiewicz noted the significant progress made on the parcel, despite trying circumstances the applicants had been through and extended her gratitude to Mr. Pipan and his client for their perseverance. The vote was then taken on the motion to move this measure to Council with a favorable recommendation and passed with 9 "ayes."
