Your Committee on Planning,to which was referred Bill No. 36,reports as follows:
Bill No. 36 amends Ordinance No. 723-81 to reclassify lands from Single Family Residential
(RS-10)to Neighborhood-Commercial (CN-10) at Waiakea, South Hilo, Hawaii. Tax Map Key:
2-2-041: Portion of 75. The applicant is Kelly Kagimoto.
Bill No. 36 was introduced by Committee Chair Ashley Kierkiewicz, by request. The applicant,
Kelly Kagimoto, and her representative, Daryn Arai, appeared before the committee in the Hilo
Council Chambers. Mr. Arai provided background information on the request to reclassify. The
back half of the property was previously zoned with the intention of building a housing complex.
Ms. Kagimoto was unaware of this when purchasing the property in 2019 but learned of the issue
as she proceeded to develop the parcel to expand neighboring retail operations, Kagimoto Store.
Mr. Arai clarified that there were no conditions of approval as part of the ordinance because the
property is part of a legacy zoning.
Committee Members Sue Lee Loy and Matt Kaneali'i-Kleinfelder expressed their gratitude for
the family run operation and their offerings. Committee Chair Kierkiewicz noted that the request
was straightforward and eliminated conflicts brought by the mismatched zoning designations.
The vote was then taken on the motion to move this measure to Council with a favorable
recommendation and passed with 9 "ayes."
Your Committee on Planning is in accord with the purpose and intent of Bill No. 36 and
recommends its passage on first reading.
