At the April 15 meeting I asked the Commission staff and the Commission for the readily available device that would allow me in future Commission meetings to type questions and comments for all to see,as an accommodation, The responses were positive. In the below referred to letters involving Chair Mfr. Vitousek and me, and also in discussions with Assistant Corporatiorn f ounsel Yoshimoto, I suggested that all the Commissioners have specific instruction in Robe t°s Rules of Order asci the current procedures of the Commission. Chair Vitouseke'response was"I agree that additional training will be beneficial for all commissioners who would;ike to participate." See Exhibit C below. Counsel Yoshimoto's response in our discussions was also positive. independently, Mr Chuck Flaherty had written to the Commission pointing out problems and mistakes by the Commissioners,the planning Department, and Corporation Counsel as to compliance with Roberts Rules, amo suggesting assistance, including instruction or help of an independent and professional parliamentarian, in order to have p of; r understanding and cornplianee with Robert's Rules. Mr, F arnety's letter is attached hereto as Exhibit A. I had no' involvement in or prior knowledge of f'rr. Flaherty's letter. Attached as Exhibit Ira is my letter far Chair Vitousek of last.April 13, Attached as Exhibit C is Chair Vitousek's resoanse to me of April 13th. Attached as Exhibit D is my April 14th response to Chair Vitousek's April 13th letter. Attached iseEx i bii W is Chair Vitousek's confirming letter of April 141h. Please review these in sequence. They speak for themselves,,. confirm my recent instruction from Counsel Yoshimoto,and indicate Chair Vitousek's satisfaction and acceptance.ot my continuation as Commissioner. In regard to my March 25th formal written request to have possible conflict of interest matters heard on the April 1�5 agenda, as stated in Exhibit F attached hereto,and apparently distributed to some of those concerned, at the April 15 Commission meeting Mr, Dern under the Agenda category of"Announcements"formally admitted the alleged conflict of interest and apologized for it, and stated how he planned to try to avoid such conflicts in the future by the use of his staff, .although ie would not be releasing his prior client list to the public. He referred to bringing the matter to the Board of Ethics, and indicated that the written opinions or statements of the Board of Ethics would be shared with the Cominiss?on. It appears that this latter matter was at Chair Vituousek's prompting, if there was any need for later further discussion. Deputy Corporation. Counsel Campbell then made an"Announcemrent"to the effect that she was a beneficiary of the Campbell trust"; she would recuse herself as counsel from future matters involving Campbell trust property before the Planning Department,the Leeward Planning Commission,and P.O.N.C.,"`and she had or would also go°o the Board o, Ethics, and its written opinions and statements would be shared with the Commission. `— Her interest In the trust tied not been disclosed by her or Mr. Kern, as the trust's consultant, when the trust property was previously brought before the Commission for rezoning approval, and ter. Kern for the trust did not then agree to the property being subject to an old and publicaliy used trail that crossed a small porion of the property, The trail may have been an issue as to subdivision of the property,which subdivision Mr. Kern approved as Acting Planning Director(and reportedly rescinded that approval after the passible conflict arose), The trail is now being before P O.N.C,. As a result of these"Announcements",the conflicts matters were deleted from placement on a Commission agenda, See Exhibit C attached hereto. As to the April 15 meeting with the permission and instruction of Chair Vitousek, my few questions were in writing and were read by Planning Department staff,for clarity. I understand that everyone had copies of these written questions. Fellow up questions,If any, were oral. My statements to fellow Commissioners during our discussion of the Applications were oral. One Commissioner objected to the reading of some quest€ons as to the second Application, but Chair Vitousek explained how under the circumstances it was proper and the Chair would control the situation. My questions and statements were relevant and short, concerned only the/Manning Department's presentation or the Applications and the Applications themselves, and were reflected in the eventual motions made, My demeanor was reasonable:and the Commission procedures and the Chair's instruction were followed. I continue to have the support of the community. See Exhibits H and I attached hereto. Administrative Matters This testimony is soler, intended to provide important information to improve the adrP inisr atzor and support of the I-eeward Planning Commissioners by county goverment. Mule 1-5 of the Rules of Practice and Procedure of E.he Leeward and Windward Planning Cornmission states, in part, "The parliamentary procedure to be utilized by the Commission in the conduct of its own rmeeti c, shall be based on the current edition of Robert's Rules of Order." During discussions of the April 7. 2021 county council Planning, Committee, a member of the Committee asked, "Are members advised on their ability to use points of order' The Planning Department's response was: "I don't believe it goes to that level," The Committee member asked whether LPC, members=are reminded during LPC meetings of their ability to make points of order and other parliamentary procedures to keep or restore decorum, The Planning Department's was "It's quite different [than the county council], lt's a lot ffiendller..the chair oretty :much rolls with it...the Commission still follows the general format of Robert's Rules of Order, but it's always becn a bit di erent." A Committee member also asked about the "on-boarding process" for neva commissioners related to parliamentary procedure, The Planning Department responded, "on l obert"s Rules of Order, focusing on the authority of chair...that they [Commissioners] must stay on merits of application...are courteous to one another.'; The LPC is one of the most powerful and inf'uenda1 volunteer organizations m our county government. It deals with matters that cart have great impacts on the lives ofmarAy people and involve millions of"dollars each year. These are serious matters that deserve strict compliance with the Rules of Practice and Procedure. This vNas suggested by Council members at the recent Council Committee on Manning meeting. 1 arra under the impression that the Council and Committee will be reevaluating my demeanor at the April 15 Commission meeting at their May A Committee meeting, The April 15 meeting;is the only meeting before the May 4 meeting. Instruction on the Zoom process would also be helpful for all concerned. l am trying to review a written, power point presentation from the Commission's staff today or tomorrow(via Ms. Sauer) due to the shortness of time beware the April 15 meeting and my schedule. l must carry out my Commission ership at the April 15 meeting and plan on doing so. Mr. Vitousek as Chair need not be concerned. Past objected to behavior will not be repeated. Mr Vitousek's letter mentions an apology.
