Dear Mr. Smith,
I'm an "absentee" property owner in Nanawale Estates (Lots 346/347, Unit 3B), and have been
since 1971 when I purchased the lots while enroute to my second tour of combat duty in South
Vietnam.
I was faz from rich at the tone, and I remain so now. My decision to buy came only after I had
thoroughly reviewed the covenants, conditions and restrictions applicable; the subdivision plot
and development plan, as approved by County of Hawaii authorities; and the probability of an
increase in property value over time.
My investment was then--and remains now--of value only to the extent that county officials were
acting in good faith when the subdivision plot and development plan were approved, to include
appropriate zoning within the development boundaries to meet the eventual needs/desires of all
who invested in Nanawale Estates. To arbitrazily change zoning within the development now, as
I am advised you and certain other members of the council aze considering, would be a breach of
faith and trust.
I am further advised that a change in zoning from "open space" to "agriculturaUresidential" may
be made only if there exists a "compelling public reason" to do so. To my knowledge, no such
compelling pubhc reason exists, nor is one likely to develop in the foreseeable future if costs of
building on the island remain at their current levels, or increase.
These things being so, as they are, I'm sure you will understand that I firmly oppose any change
that reduces the amount of open space within Nanawale Estates, or in any similarly funental
way alters representations by the county and developers to prospective buyers, past or resent.
