SUBJECT: Proposed Amendment to Bill No. 34; AN ORDINANCE AMENDING SECTION
25-8-33 (CITY OF HILO ZONE MAP), ARTICLE 8, CHAPTER 25 (ZONING
CODE) OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS
AMENDED), BY CHANGING THE DISTRICT CLASSIFICATION FROM
OPEN TO INDUSTRIAL–COMMERCIAL MIXED–20,000 SQUARE FEET
(MCX-20) AT PIOPIO, WAIAKEA, HAWAII, COVERED BY TAX MAP
KEY: 2-2-001:008, 017, 018, 019, 024, 030, AND 034.
Please see below proposed amendments to Bill No. 34. These proposed amendments are
illustrated in Ramseyer format with respect to the contents of Bill No. 34 (new material is
underscored).
1. SECTION 2 of Bill No. 34 is amended by adding new Condition K to read as follows:
"K. The applicants) shall create a 20 foot shoreline setback from the high
water mark for all parcels within the proposed rezoning ordinance which
directly abut the waters of the Wailoa river/estuary area. If structures exist
within the proposed setback area, these structures will be permitted to
remain until:
1. natural disaster or otherwise unforeseeable event causes such
structure to be removed or demolished or
2. demolition or substantial renovation work is undertaken to the
structure in the setback area." '}

M to now read as Conditions L through N.
Due to the limited scope of these amendments, a draft copy of Bill No. 34, in its entirety,that
