Dear Chairman Kanealii-Kleinfelder,
Thank you for requesting a discussion with the Mayor, Planning and Finance Departments about the CIP
Budget.
The Bill 22 Draft 2 plays another shell-game with the Naalehu project surrendering the "re-appropriated"
$6.5 mill for $10.2 mil in County taxpayer bond money.
Instead, Finance has put forth "construction" funding of$5.5 mil for the Pahala sewer project. Since the
site has lava tube problems discovered in a belated geotechnical survey (YKE signed contract Dec. 2018
attached), ironically also paid for under c.008130, how can ANY kind of construction happen before more
environmental review happens - years from now??
I cannot understand why DOH-WW Chief Sina Pruder made false statements (June 30, 2020 HID
Declaration attached 3 pages) about the $4,188,804.00 she gave COH in December 2019, but it is clear
something funny as been going on.
I look forward to hearing what everyone has to say and thanks for asking the questions!!

Subjects Further evidence of fraud and misuse of Hawaii CWSRF for Pahala LCC Closure Project
Aloha,
I have more evidence that State of Hawaii DOH-WW has provided millions of dollars of CWSRF loans to
the County of Hawaii for nothing but endless design and NO CONSTRUCTION of two Ka'u wastewater
projects!
On June 30, 2020, the DOH-VVW Chief, Sina Pruder, attested in the US District Court that "DOH has not
encumbered any funds or committed to provide any funding to the County for the [Pahala]
Project." (attached)
However, that was not true as she signed a Commitment Notice on December 11, 2019 to give County of
Hawaii $4,188,804. (attached)
Further a new Expenditure Group Budget Report category of"699.5698.39 Pahala Wastewater System -
SRF" was entered during the December 1, 2019 through December 31, 2019 Period 6 for
$4,188,804.00. (attached)
And a new document, Certification of Availability of Funds (attached) shows complicity of the COH
Director of Finance in spending this CWSRF loan funding ($4,188,804.00) in the fraud because the
funds were misused on preliminary activities including environmental review and NONE are being
used on CONSTRUCTION!
This same CWSRF funding is in the current CIP Budget Bill 22 Draft 2 Page 15 (attached) as $4,189
(thousands) to be used, again, just for design.
Proof of the lack of construction is in the Brown and Caldwell contract c.008130 for $4,300,000 -
parts attached.
