SBCC has engaged a permitted interaction group to study this appendix and has advocated to keep it status
quo pending the work of these subject matter experts.
Councilmember Tim Richards asked about the timeline of this work. Mr. Tanaka stated his best guess was
six months to a year since they just started working with definitions and making sure all aspects were
aligned. Couneilrnember Richards remarked that this helps with our previous discussion on affordable
housing.
Councilmember Rebecca Villegas asked if the County did an Economic Impact Study. Mr. Tanaka answered
that assessments were made by the State Building Code Council and there was an extensive national study
attached to the code.
Corporation Counsel Dalilah Schlueter explained that a proposal was sent to Governor Ige to suspend
HRS 107-28 to allow all counties to have more time to implement the code changes during the pandemic.
The request to suspend was made, but Governor Ige did not suspend and our County decided to make
the business decision, under emergency proclamation,to allow an administrative grace period until
August 31, 2021.
In response to numerous questions, Mr. Tanaka stated the 2006 code is being enforced; 2012 is optional.
Factory built structures are being designed to 2006 code. However, they do have the option to design to
2012 codes. He also stated the Factory Built Appendix is intended to reside in the IRC. In response to more
questions, Mr.Tanaka remarked that the County does not have control over commodity prices; the County
enforces the minimum requirements of the code.
Ms. Schlueter also reminded the Committee that if a County fails to adopt the current code, it defaults to
whatever the State code is. This particular grace period is for the 2012 code. Therefore, if the 2018 code is
not adopted by the end of the grace period, the County would default to 2012. Chair Lee Loy added a
clarifying statement regarding it defaulting to the State's amended 2012 code, which would be without
county specific amendments.
Councilmember Ashley Kierkiewicz expressed her appreciation for all of the space and hard work provided
for design professionals and the community to give feedback on these codes.
Your Committee on Public Works and Mass Transit is in accord with the purpose and intent of Bill No. 44,
and recommends its passage on first reading.
