Identify the specific regulations that give the Mayor and/or Planning Director authority to unilaterally
pause appointments to the ACs and KVDC.

"...to my knowledge the CDPs right now are put on hold and I was told not to fill the CDPs and
the Kailua Village Development Plan that [sic] commission right now."

Explain why the public and County Council were not informed of the pause on appointments—
and possible dissolving of KVDC--until Councilmember Villegas happened to ask about vacancies at the
March 17, 2021 Planning Committee.
Explain how legal requirements are being met--for the mayor to appoint AC and KVDC members, and for
each body to have nine members.
"The [Kailua] design commission shall consist of nine members who shall be appointed by the
mayor with the approval of the council."
Hawai'i County Code, section 25-7-2(a)
"CDP action committees shall consist of nine members...The members shall be appointed by the
mayor and approved by the County Council."
Hawaii County Code, Section 16-5(a)
Explain how the ACs and KVDC will attain the quorums necessary to meet their obligations without a full
slate of members.
"The purpose of the CDP action committee is to be a proactive, community-based steward of the
plan's implementation and update."

"The design commission [KVDC] shall provide an architectural and design review of applications
requiring plan approval by the director."

Describe how the Mayor and Planning Director plan to restructure the ACs and KVDC, and what
regulations their restructuring plan follows.
Zendo Kern:
"...the CDP Action Committee, we're giving these a little bit of pivot in the sense of working
toward empowering the Action Committees to take action within their communities that's different
from what they have been doing, which is a little bit more advisory...we want to get this set up so
when we get the new AC members coming in...[we] have the framework for them to take action."
"...the Kailua Village Design Commission-] think one of the last projects took about three years
to get through. It's not really acceptable and we want to see things progressing. Obviously, we
have to have the processes in place."

Describe what the Mayor and Planning Director are doing to ensure that the ACs and KVDC represent a
cross-section of the community. There is concern that they will be shaped to favor development and
special interests over sustainability and environmental protection.
