Re: Communication 279
Aloha Madame Chair and members of the Planning Committee,
3
This nominee has an excellent educational background in planning and experience as the project
manager for "West Hawaii's leading real estate development and general contracting firm for the last 25
years" (tinguelydevelopment.com).
I would like to point out that, while LPC meetings often have disclosures of potential conflicts of interest
related to real estate development, I am unaware of any potential conflict of interest related to cultural
and/or environmental organizations being disclosed. Why?
The reason is that no one directly involved in the advocacy for or protection of our county's
constitutionally-and charter-protected resources or the public trust are serving on the LPC.
In order to determine whether or not this nominee adds to the diversity of the LPC, I hope the Planning
Committee will question this nominee's experience and knowledge of Hawai'i's unique culture and
environment,as well as the laws, rules, and regulations that protect cultural and environmental
resources.
Given the massive list of former clients that have already required Planning director Zendo Kern to
recuse himself from numerous applications over the past six months, I hope the Planning Committee will
also determine the extent to which the current nominee has or may have potential conflicts of interest
with applicants to the LPC, especially related to the upcoming revision of the General Plan.
Perhaps it would be appropriate for the nominee to seek an informal decision from the Board of Ethics
on this matter.
Mahalo for this opportunity to testify,
Chuck Flaherty
Captain Cook, HI
COMITI.
