Dear Chair Lee Loy,
I would like to commend and thank you and the Department of Public Works for your combined
efforts and hard work with developi,ng the proposed Building Code amendments. Further,I would like
to submit this letter and written testimony in support of Bill 44 as drafted. I would also like to
respectfully request that the County Council postpone any consideration of amending Appendix U,
Factory Built Housing, until such time that the State Building Code Council's Investigative Committee
concludes its review of this construction concept.
As you may be aware,the State Building Code Council (SBCC), by statute(HRS§107-24), is
charged with the duty to establish our Hawaii State Building Codes. Upon establishing those codes,the
Counties then conduct their respective reviews and possible amendment for adoption at the local
jurisdiction level. Given the complexity of the subject of Factory Built Housing, Manufactured Housing,
Modular Construction,and other off-site construction methods,the SBCC formally established an
investigative committee to research this topic and provide possible recommendations to the SBCC for
consideration. Given that this process has been initiated and the committee has just begun to convene
and discuss this issue,it would appear to be both prudent and responsible for the County Council to
postpone any consideration of amending Appendix U until such time that the SBCC receives the
recommendations of the committee. This may afford the County Council the opportunity to review the
findings of the committee and avoid the possible adoption of code provisions that may be in conflict
with what the SBCC may consider to be incorporated into the state code. This postponement of any
action at this time would also afford the County Council with the opportunity to capitalize on the
research findings of the investigative committee in considering amendments at the local level.
Thank you for the opportunity to provide testimony in support of Bill 44 as drafted and for your
consideration of my request to postpone any action on amending Appendix U at this time. I am also
hopeful that with the passage of Bill 44 there will be opportunity to further collaborate with the Building
Division on the implementation of the codes and the associated processes in support of safe and
effective design and construction.
