RESOLUTION AUTHORIZING THE ACCEPTANCE OF ALL
DONATIONS OF SECURITIES OR PERSONAL PROPERTY TO THE COUNTY OF HAWAI‘I WITHIN THE CURRENT FISCAL YEAR (FY2022) THAT ARE NOT COVERED BY THE DEPARTMENT OF FINANCE’S CAPITALIZATION PROCEDURES.
WHEREAS, Article XIII, Section 13-12, of the Hawai‘i County Charter provides that the Council, on behalf of the County, may accept gifts of donations of money, securities or other personal
property or of real estate or any interest in real estate, and Chapter 2, Article 30, Section 2-162 (b), of the Hawai‘i County Code states that a gift or donation of money, securities,
or personal property not covered by the capitalization procedures (of the Department of Finance) shall be submitted to the Council by letter for its approval; and
WHEREAS, donations of commodities not covered by the Department of Finance capitalization procedures are made by various entities throughout the year to the County of Hawai‘i and are
accepted by the Hawai‘i County Council via letter during a duly noticed meeting of the County Council; and
WHEREAS, although both the executive and legislative branches of the County of Hawai‘i place a high priority on expediting the acceptance of these donations, the process is often lengthy;
and
WHEREAS, it is in the best interest of the public that a more expeditious manner of accepting uncapitalized donations be implemented; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that henceforth, all donations within the current fiscal year (FY2022) that are not covered by the capitalization procedures (of
the Department of Finance) shall be deemed accepted
by the Hawai‘i County Council, on behalf of the County of Hawai‘i, upon receipt by the County, provided that at the end of each fiscal year a report of the donations received is submitted
to the Council by the Finance Director.
BE IT FURTHER RESOLVED that this method of accepting donations not covered by the capitalization procedures (of the Department of Finance) shall remain in effect until it is rescinded
or otherwise modified by the Hawai‘i County Council.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Department of Finance and the Office of the Mayor and to the Corporation Counsel.
