RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR AGREEMENT WITH THE STATE OF HAWAI‘I EMPLOYEES’ RETIREMENT SYSTEM
(ERS)
WHEREAS, the Department of Finance wishes to enter into a multi-year agreement for three (3) years with the State of Hawai‘i Employees’ Retirement System (ERS); and
WHEREAS, the agreement will allow the County to obtain information that will be provided by the ERS actuary which will be needed for the County’s financial statements; and
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution; and
WHEREAS, Hawai‘i Revised Statutes, Section 46-7, requires that County departments obtain the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant
to those powers; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I:
In accordance with section 46-7, Hawai‘i Revised Statutes and Section 10-11 of the County Charter, that the Mayor of the County of Hawai‘i is authorized to execute, on behalf of the
County, a six (6) year agreement, and related documents with the ERS to allow the County to obtain information from the ERS as specified above.
That sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai‘i shall transmit copies of this resolution to the Office of the Mayor and the Finance Department.
