Introduction <br /> This report has been prepared pursuant to Council Resolution No. 158-21 ("Resolution"), dui _ <br /> adopted on July 7, 2021. The Resolution accepted the RCFC Kaloko Heights, LLC's Petition to <br /> Institute Community Facilities District to Construct Sewer Line Extension and Related <br /> Improvements from Kaloko Heights to Existing Sewer Line Terminus in the Vicinity of West <br /> Hawai`i Civic Center, Kaloko and Kohanaiki, North Kona, Hawai`i, in accordance with the <br /> requirements of Hawai`i County Code (HCC) Chapter 32. The twelfth provision in the enacting <br /> clause of the Resolution further directed the Director of the Department of Environmental <br /> Management(DEM)to prepare and submit a Report of Facilities to the Council pursuant to HCC <br /> Section 32-21 which requires the Director: <br /> "to study the proposed district and, at or before the time of the hearing (or within sixty <br /> days after adoption of the resolution of intention, or such earlier date established by the <br /> council, if the hearing is waived pursuant to section 32-24), file a report with the council <br /> containing a brief description of the proposed facilities by type which will in their <br /> opinion be required to adequately meet the needs of the district, and their estimate of the <br /> cost of providing those facilities." <br /> The proposed Community Facilities District(CFD) contemplates the issuance of Special Tax <br /> Bonds to fund the design and construction of a sewer line that will be installed in portions of <br /> Hina Lath Street and Ane Keohokalole Highway Rights-of-Way (ROW), connecting the Kaloko <br /> Heights project area to the existing sewer lines within Ane Keohokalole Highway that connect to <br /> the County's Kealakehe Wastewater Treatment Plant(WWTP). Upon completion of the sewer <br /> line improvements,the County will own, operate and maintain the system. <br /> The proposed improvements, consisting exclusively of a sewer system, including the incidental <br /> restoration of roadway and related improvements, are consistent with HCC Section 32-7(j) which <br /> allows,wastewater systems or facilities to be financed by a CFD.
