HomeMy WebLinkAboutCOM 0281.036 2020-2022 rill 94 From: John Hetherington Sent: Tuesday, July 20, 2021 11:05 AM To: Council Testimony Subject: Bill 44 proposed and proposed amendment in COM 0281.016 2020-2022 i 3 While I continue to support Bill 44, I have a concern about the amendment noted in COM 0281.016 2020-2022 under Section 513-1-7 noted as item "e", and do not recommend its approval as written based on the following considerations. S In Section 5B-1-3, Scope Exceptions, as drafted in Bill 44 Draft 01,the opening paragraph states: "This Chapter shall apply to the design, construction alteration, movement, enlargement, replacement, repair, equipment, use and i occupancy, location, removal and demolition of detached one- and two-family dwellings townhouses not more than three stories above grade plan in height with a separate means of egress and their accessory structures not more than three stories above grade plane in height." I This paragraph is a "description" of applicability for the International Residential Code and is taken directly from the IRC as noted in Chapter 1, Administration, Section R101.2 Scope. This paragraph does not indicate "structural standards" which would be required to be met. The structural standards to be met are in Chapter 3 Section R301, Design Criteria. These are the Structural provisions of the IRC. i • If a version of this amendment is included in Bill 44,then IRC, Chapter 3, Section R301 Design Criteria should be noted as the Standards to be met if no structural review by the County is required. • Even if Section R301 is referenced if there is no structural review by the County Building Department, what documentation of compliance with the Design Criteria would be required? • While there are projects that meet the prescriptive requirements of Section R301, as also noted in R301.1.3 it is very common in Hawaii on our Island that projects here often have "certain structural elements" which do not comply with the prescribed limits of Section R301. In these cases the IBC becomes the structural standard. Who will review plans to verify compliance? Again, as written I strongly recommend the amendment not be approved.
