Correa Trust TMK: (3)2-4-003:021 Dear Chair Kierkiwiecz and Members of the Committee: It has come to our attention that your committee has been requested to review the above request for time extension. Enclosed is a tax map showing the Applicant's property shaded in green and the properties owned by us in crosshatch. Attachment 1. We own Parcel 75 as husband and wife, and Parcels 76 and 97 are owned by the Jennie S. Wung Trust, for which Aileen Yeh is a trustee. It should be noted here that these parcels are actively used for agricultural purposes(greenhouses, plant nursery and pasture. We did not receive written notice of the zoning extension request or the previous Planning Commission hearing on the matter, but learned of the status of the request through other means. We now have the Planning Commission's recommendation and have these comments and concerns which should be addressed. Parcel 75 takes access over a 50 foot wide road and utility easement that is located between the Applicant's parcel and the Life Care Center. The Easement is a pole portion of Parcel 97 owned by the Trust. It is shaded in yellow. Attachment 1 The Applicant also has a road and utility easement over the Easement. it is that same Easement over which the proposed development will likely take access and over which we access to get to our lot and the Trust's other property. The Easement also provides access to the Life Care Center's employee parking lot, kitchen and supply delivery area. There is no turning radius at the intersection of the Easement with W. Kawailani Street. Attachment 1 Please note that we do not object to the requested extension of time to complete subdivision improvements. However, as we understand, the main access to the proposed subdivision is required to be located over the 50 foot wide Easement. Approximately 20 or more lots may be developed in the proposed subdivision. As such,our concern is that the conditions of the zoning ordinance should specifically address the multi-use aspect, vehicle movement, safety and parking related issues which adding the subdivision traffic will create to an existing condition that has Comm. Some background information is in 3 order. The Life Care Center has approximately 60 employee parking stalls in the rear of 3 the Center(some previous spaces were removed to allow for a wastewater facility for the Center),that were likely sufficient under previous ly required staffing requirements. It also has approximately 40 stalls fronting Kawailani Street intended for visitors and devoted for physicians, plus handicap parking. On a typical day, most recently on i Monday, June 28, 2021, there were approximately 47 employee vehicles in the rear parking area, and 40 employee vehicles parked along each side of the Easement. Included with this letter are photos of the locations depicting the described parking situation. Attachment While the Applicant did not create this situation, by adding traffic to the 3 3 Easement, over time, staffing requirements for the Life Care Center have apparently increased, and the proposed development will need to accommodate these conditions in order that a safe and workable road for vehicles and pedestrians alike. When Covid issues diminish, there will undoubtedly be more visitors, and increased pedestrian use, including that generated by the proposed subdivision. Given the above, we respectfully ask that as part of the conditions of the zoning ordinance, it be clarified or required that: I. The term "internal roads"as contained in Condition D be stated to expressly include the 50 foot wide Easement portion of TMK: (3) 2-4-003:097, such that curbs, gutter and sidewalks meeting with the approval of the Department of Public Works are completed in the Easement as a condition of final subdivision approval. 2. If the main access to the subdivision is required to be taken off the 50 foot wide road lot, the Applicant should be required to provide engineering and traffic control plans which are designed to address (a)access from Kawailani Street, and (b)accommodate required turning radius at Kawailani Street and the entrance into the subdivision. The Applicant has sufficient area to satisfy these more specific requirements and address the foregoing concerns.
