We do have some staff available here, Deanna Sako and our Parks and Recreation Deputy Director. And I did see some staff earlier, but as we ran over our schedule here, they may be on their way or they may have left, so I apologize for the inconvenience, if Council Members had questions. With that, let's go to Resolution 180-21, so we can take care of some of our staff who are present here. Change Order As directed by the Chair and with no objection from the Council Members, of Business: the following items were taken out of order: FC -17 August 17, 2021 Res. 180-21: AUTHORIZES THE ACCEPTANCE OF A DONATION OF TWO HISTORICAL SIGNS TO THE COUNTY OF HAWAII DEPARTMENT OF PARKS AND RECREATION The donation from Malama Wai`aha, valued at approximately $10,000 would be located at Wai`aha Beach Park to commemorate the birthplace of the bodyboard. Reference: Comm. 349 Intr. by: Mr. Kaneali`i-Kleinfelder (B/R) CHR. KANEALI`I-KLEINFELDER: May I have motion, please? Motion to Approve: Ms. Lee Loy moved to recommend adoption of Res. 180-21. Seconded by Mr. Inaba. CHR. KANEALI`I-KLEINFELDER: Council Members, discussion? MS. VILLEGAS: Yes, please. CHR. KANEALI`I-KLEINFELDER: Go ahead, Ms. Villegas. MS. VILLEGAS: This is really exciting. We recently had an event done, where which due to COVID (Coronavirus Disease) could not have a gathering of people that we would have liked. But Wai`aha actually was where Tom Morey lived back in the '70s, and he took a surfboard that had been broken in half and shellacked it with newspapers, and created the first bodyboard and rode it right there at Wai`aha. The signage that's being created in collaboration with the Kailua Village Business Improvement District and some of the signage that you can already see in Kona is really fantastic. It gives reverence to the anniversary of the invention of the bodyboard, which was 50 years ago. It also gives reverence to and accolades to Mr. Tom Morey, who just celebrated his 80th birthday, as well as highlighting the historical nature of wave riding, and the cultural significance in our host culture, and with images and examples of wooden boards ridden prior. So I wanted to clarify that by no means that it's a claim that the original wave riding board was created by Mr. Tom Morey. But this is that bodyboard, the one that was originally made out of a broken surfboard. So, we are really excited for the opportunity for this to be placed. Parks and Recreation has been an incredible partner with Malama Wai `aha; and Krista Donaldson, and her work to perpetuate and to continue native planting at Wai`aha to help stop shoreline erosion. And there's just been an incredible collaboration between this community group, our Parks and Recreation department, and the Business Improvement District to create these signs that will Page 2 FC -17 August 17, 2021 educate people about the history and some of the sacredness of the area as well as to ideally encourage them as they enjoy time at that park; to water the plants that are being planted there that protect our coastline. And just the really, really cool history we have on our Kona Coast as it relates to the history of modern day surfing and wave riding. I myself, I am a bodyboarder, and I just love the sport. I'm so grateful for Mr. Morey and what he did in that exact space and on that reef. And with that, I yield. CHR. KANEALI`I-KLEINFELDER: Thank you, Ms. Villegas. VILLEGAS: I just want to mahalo the people that have come together and they're helping to fill in the gap for what Parks and Recreation is not able to afford, when it comes to the resources available at our Kona Pool. It is such a widely used asset. So cherished by our community and the different sporting organizations that utilize it. I think this is a fantastic example of people coming together, identifying those that may have resources, and that are willing to contribute and to participate in the betterment of our County Parks and Recreation. I'm really grateful for these relationships and these connections and the provision of resources and filling gaps. So, thank you to Parks and Recreation for your continued commitment to working with our community, and thank you to our generous community for your participation and investment in our County resources. Page 5 FC -17 August 17, 2021 Certainly, in this particular issue with our Kona Aquatics Pool—however, just to cross the board, in everything Parks and Recreation does, we have so much community support. We have Friends of Parks agreements at many of our parks, and we're grateful to all the work that community members are doing. So I just wanted to echo that "thank you" also. Mahalo. CHR. LEE LOY: Hi, Clifford, thanks for being here. I had a question in regard to the litigation, regarding— CHR. KANEALI`I-KLEINFELDER: Ms. Lee Loy, give us one second. MS. LEE LOY: Oh, there he is. CHR. KANEALI`I-KLEINFELDER: We're missing Relley right now, to get Mr. Victorine lined up. MR. VICTORINE: Present. CHR. KANEALI`I-KLEINFELDER: Oh, here we go. Okay, go ahead, Ms. Lee Loy. Sorry for that interruption. MS. LEE LOY: Hi, Mr. Victorine. Thanks for being here. You know, on your quarterly status update, settled claims, we have a settlement amount of $10,000 Page 7 FC -17 August 17, 2021 for "Plaintiff alleges that during DPW (Department of Public Works) road construction uneven roadway causing him to lose control of his motorcycle and crash," can you provide context around that settlement amount? MR. VICTORINE: The amount? MS. LEE LOY: The context around how that decision—how we got to that decision. Because, Clifford, you know where I'm going to go with this question after. MR. VICTORINE: As you know, that's the max that our office has the ability to settle without having to go through, you know, Council and further approval. So that is how that amount came up. MS. LEE LOY: I guess I'm going to ask how did we get to the determination that County was responsible for this incident? MR. VICTORINE: Yeah, this—there's a little more than whether or not we're responsible or not. So we're saying that this was going into litigation, and it was reviewed and found that this was more of a settlement in our case in this. So as you see this is listed as a settled case, it's under litigation, but this was in the process of, if we don't settle it, it goes to court. MS. LEE LOY: And I'm just going to throw it out there because—and I'm looking at this because it's related to road construction on an uneven roadway causing an incident. And down in Keaukaha we have had a number of claimants make claims that damages to their vehicles because of the ongoing road construction. And so I'm just trying to understand how the County kind of came to the conclusion that this was some level of shared responsibility, because I think the community in Keaukaha really deserve some attention when it comes to that ongoing construction and the complaints that they are making to damage to their vehicles. You don't have to answer Clifford, I'm just sharing my concern and the frustration that a community is having, and so when I saw something like this, I'm just trying to draw some parallels. RICHARDS: Okay, thank you. Thanks, Deanna. So as I read this, we have $470 million outstanding, of which $53 million is—will be reduced by the four things you articulated. So we have an outstanding net of about $416 million, is that accurate? MS. SAKO: That's correct. MR. RICHARDS: And then, what is the potential for our County? How—what is our limit? Where are we in all of that. MS. SAKO: Currently, as budgeted, we're at about -10 percent of our budget goes to debt service, and so we feel comfortable going up to 15 percent. That was a former GFOA (Government Finance Officers Association), you know, recommendation, and so we try to stay within that. With everything that's been authorized to be issued but hasn't necessarily been issued yet, we would—if we issued it all today, we would be at 13—a little over 13 percent. MR. RICHARDS: Okay thanks, Deanna. I think I asked you this question repeatedly, but just like to know where we are with the County perspective. So, thanks very much. Chair, I yield. I mean, this is a total of about $51,200 worth of donations from Honolulu, and given what we've been through in the past two months and a number of fires, it is much needed for our Fire Department, probably understates what we need but, you know, here we here we are. LEE LOY: Yeah, Deanna, just a quick question. Now that we have that six-year in place, does that also help forecast, you know, for our future budget and budget requirements, or is it more just succinct with that year? MS. SAKO: So this one is actually to comply with the GASB statements and for the specific year. However, ERS does have their own actuaries that do more of a look -forward. But as with anything, those are only estimates and cannot be specific as to what the investment returns are going to be throughout the life of the plan. But as a reminder, for ERS, our payments are based on the actual salaries and wages that we pay to our employees, so those rates are fixed right now. And I'm hoping there is not going to be any further increases, you know, placed upon us by the Legislature. MS. LEE LOY: Yeah, and a follow-up to that. You know, like how—you know, we get these mandates from the State, and we're required to provide. Is the State, like with the lifeguards or some of the other requirements we have for employees, is that coming from the State or is it still coming from us? MS. SAKO: I'm not sure I know what you mean, specifically for the lifeguards and that. But we comply with like whatever requirements there are per HRS (Hawai`i Revised Statutes). So the percentages that we pay in are—you know, I think it's the 24 percent for general employees and 41 percent for Police and Fire, and those rates are kind of set. We do have spiking bills and other bills that we receive from ERS, as well, that we try to control to the best of our ability. MS. LEE LOY: Thanks, Deanna. I yield. CHR.
