SUBJECT: Minutes of the Hawaii State Association of Counties (HSAC) Executive Committee
Meeting held on September 23, 2021, and Special HSAC Committee Meeting on
September 29, 2021.
Please find the attached minutes of the HSAC Executive Committee Meeting held on September 23,
2021, and the HSAC Special Executive Committee Meeting held on September 29, 2021,to be
presented for informational purposes to the Governmental Operations, Relations and Economic
Development Committee.
Please place this matter on the agenda for the next available Governmental Operations, Relations and
Economic Development Committee.

HSAC EXECUTIVE COMMITTEE MEETING (Via ZOOM)
September 23, 2021
I. CALL TO ORDER
The meeting was called to order by CM Chock at 1:06pm
In attendance:
Council Members- Tommy Waters, Kelly King, Mason Chock, heather Kimball, Felicia Cowden,
Tamara Paltin, Bernard Carvalho;
HSAC Lobbyist, .Ion Okudara; and,
Others: Isaiah Shigematsu, Chico Figueiredo, Kamakana Watanabe, Nahelani Webster Parsons,
Aida Kawamura, Axel Beers, Josh Standbro, George White, Kasie Takayama, Ellen Mckinley,
II. APPROVAL OF AGENDA
Agenda was approved as amended with no objections.
III. MINUTES
A. August 26, 2021 Executive Committee Meeting Minutes
CM Chock asked i,f there is interest to link the meeting recordings to the minutes that are
posted on the website or in the archives. CM Kimball: does have the recordings available and
accessible to the committee but the recordings can be made available. CM Chock: wanted to
make sure he was following up on it and they can circle back to it so that it can be made
available to those who can't make the meetings or to the public.
Approved with no objections.
IV. REPORTS
A. Treasurer's Report-
CM Waters, Treasurer, reported the following:

As of August 23 2021:
Balance ofprimary HSAC account is $135,398.26.
Balance of HSAC conference account is$52,796 41.
Total deposit account balances is $188,194.67.
CM Waters: Currently working on taxes and they have requested information from the
accountants and his office is working on resolving a charge on the card
CM Chock: Would like parameters around the card usage for HSAC. When Maui was heading
treasure accounts, they created a policy around the debit card and will re-share the information.
Action item to review Page 19 in the by-laws regarding finances.
Treasurer's Report was accepted for audit with no objections.
B. County Reports
1. County of Hawaii-CM Kimball reported that the HSAC conference has new dates for
the conference that are September 28, 2022 - October 1, 2022 (Wednesday through Saturday).
TicketSpice ticket dates have been changed. Existing registrations are carried over. 9 total
sponsors for a total of$33,000. Budget goal for sponsors is $65,000. New hotel rates have
increased from $259 to $299 for the conference lodging. Innovation Grant from Hawai'i County
R&D will be carried over to the new dates. On September 22, 2021 a Financial Literacy
Resolution to urge the Department of Education to support legislation to include financial
literacy in the curriculum. Briefing from the finance director about the spending of the CARES
and ERAP money, $14 million in the emergency rental assistance program but very little uptake
in the program. Just about done with the TAT Legislation and hoping to have it on Oct 19, 2021
committee meeting.
2. County of Kauai-CM Chock reported that their TAT Bill did pass. The start date is
October I". Had a meeting with Nahelani and gave an overview and briefing of the position. She
would like to serve as executive assistant. They are in the process offinalizing the contract. The
goal is to have her onboard by October 1, 2021.
3. County of Maui-CMKing reported about the ERAP. Of the $36 million available, only
$11.1 million has been distributed. The county TAT surcharge passed the first reading. Second
reading will be on October 1, 2021 and the hope is that it goes into effect on October 1, 2021.
Does not affect any reservations made prior to October 1, 2021. Charter commission meeting
and they are expecting 10 or more new charter amendments for Maui including a district voting
amendment would mean candidates do not have to run on all 3 islands in every district. Maui
created a Temporary Investigative Group (TIG) to come up with some "over tourism"solutions
by speaking with groups of broad stakeholders. Passed at CARE Committee- a requirement that
homes larger than 5,000 square feet have to be built to net zero.

CM Chock- Small interjection to introduce Nahelani before Honolulu County gives an
update. Welcome from everyone and introductions.

4. City/County of Honolulu- Update from CM Waters-In Honolulu's 2020 budget bill there
was a proviso allowing the administration to have free reign of the CARES Act money. Have any
of the other counties had the same situation?Looking at some of the council priorities and
include them on how to spend the money. Budget attorney advised that they should have and
could have put the ERAPA money in the budget.
C. NACo Report No report.
D. WIR Report CMKing reported that she wasn't able to attend the last meeting but
there is an upcoming WIR National Conference in October 13-I5, 2021, in Salt Lake
County, UT without any accommodations for virtual attendees.
Motion to receive reports approved with no objections.
V. NEW BUSINESS
a. Discussion and consideration of 2022 HSAC Legislative Package and Extension of
Deadlines and Proposals
CM Waters asked ifgetting items through our councils before we submit to the HSAC board
for approval and then back to the councils for final approval the most effeceint way to do
this? CMKing-the by-laws don't say we need to send it to HSACfrom the councils first but
once we get the HSAC package ready then we take it to our councils for approval. Having
to have the bills officially approved beforehand seems like it forces too many deadlines. CM
Kimball is okay with asking HSAC to approve legisltive priorities this time around. Two
objectives are to get the bills we want this session and then to make HSAC a force
legislatively. CM Chock- The reason HSAC is getting council approval before submitting
to HSAC legislative packet review is to show that these have been vetted by the councils
which shows support when submitting to the HSAC Legislative package.
John Okudura-Believes the list is too long including in areas that we don't have expertise.
Currently concentrating on 3 or 4 bills. We should focus on 4 or 5 bills at most in the
package. CMKing- disagrees because they have had 15 bills in HSAC package before.
John Okudura- Feels certain he can finish 3 bills by tomorrow if he hears back from the
people about the taxes. He is having a hard time with the cesspools and the process of
negotiating with the unions isn't going to work quick enough. Now exploring the idea of
counties establishing wastewater improvement districts.
CM Waters-Suggests having a separate meeting just on HSAC Legislative Package.
CM Chock-recommends we come back for another meeting to figure out the deadlines and
who is going to be introducing any bills.

b. Josh Stanbro gives an update: amicus brief to support the Honolulu case at the State Court.
Same attorneys will volunteer their time if HSAC is supportive to put in an amicus brief at
the federal court level. Questions are: is HSAC in support of tapping the same attorneys to
file an amicus brief for the federal court? Maui County's case is coming up in state court.
The attorneys said they would be willing to refile the amicus brief that was filed on behalf
of Honolulu. Is HSAC willing to support Maui as well?
CMKing moves to support both Honolulu ad Maui County court cases and filing of amicus
briefs. Seconded by CM Waters. Approved with no objections.
c. Communication from Sharon Ibarra State Boards and Commission Office requesting a
nomination from Hawai'i State Association of Counties for the Hawai'i Sister State
Committee:
CM Chock- Deadline of next month and will forward any specific communications he has
received. CMKimball- recommends Jane Clemet who is an Exec Assistant to Mayor Roth.
She manages Sister City Program and does a fantastic job. Please send suggestions of
nominations.
Motion to receive and was approved with no objections.
VI. OLD BUSINESS

VI. OLD BUSINESS
Continuation of Discussion and consideration of 2022 HSAC Legislative Package and Extension of
Deadlines and Proposals
John Okudara-bill that was introduced by HSAC about immunity for lifeguards was vetoed because the
section of the law changed for the liability. There was no opposition to it before and the lifeguards
support it. Other bills are County TAT Bill (percentage to be decided by each county individually),
looking at the improvement district concept to address the cesspools. Discussion about posting times
for agenda due to the Sunshine Law.

CMKing said she can take on introducing the Lifeguard bill to her committee for approval.
CM Waters- will be introducing the County TAT bill.
CM Kimball will introduce the bill on abandoned vehicles and fees for the county.
CMKimball- suggests having a Bill tracking page on the website so HSAC can highlight certain bills
or to prove support of bills.
CM Chock-would like to put together a list of bills HSAC is to support so they can easily be agendized
moving forward.
CMChock- there will be another meeting in December to approve thefinal HSAC package.
I. ANNOUNCEMENTS
a. Scheduling of the next Executive Committee meeting- The next meeting is scheduled at 10am
on October 26, 2021.
