RE: Communication No. 402.2: Update on Transfer Station Trailer Prohibition
Attached for discussion purposes is the most recent draft amendment to the Department's Rule
No. 9-17 that was discussed by the Environmental Management Commission at its duly noticed
meeting on October 27, 2021. The EMC did not vote on a recommendation. During the course of
the discussion, individual commissioners made the following comments about the draft rules:
• Requiring written concurrence from the Mayor and Corporation Counsel to allow trailers
at a transfer station was "overkill." (This has been removed in the most recent draft.)
• Public notification should also include social and print media and clear signage with
advance notice at the transfer stations. Electronic media notice by itself is insufficient.
• Preventing reversal of trailers into the transfer stations means you are going to walk 30
feet to the chute from your trailers, in some cases.
• Most trailers on the island are 4x8 feet or 5x10 feet. The proposed rule would cut out the
10-foot-long trailers. The maximum allowed dimensions should be 6x12 feet, because
that is the largest residential trailer sold on the island by one major retailer.
• It should be unnecessary for employees to need to ask to see the trailer registration
documents, because it's on the trailer. The Police Department, not DEM employees,
should be responsible for enforcing vehicle registration laws.
The attachment represents the most recent draft of the rule amendment. DEM appreciates the
opportunity to receive additional input from your Committee prior to setting a final draft of the
rule and opening the public comment period under HRS Chapter 91.
Please distribute this to members of the Regenerative Agriculture, Water, Energy, and
Environmental Management Committee for the meeting on November 2, 2021.

Draft amendment to Rule No. 9-17 of the Rules of Practice and Procedure of the Department of
Environmental Managment
9-17. Vehicles are limited to sedans, SUVs,pickup trucks, or mini vans. [T,-aile s a„d dtHiip]
Dumb bed trucks are prohibited at the transfer station. Trailers are prohibited at transfer stations,
except as provided below:
(a) After a review of site designs safety reports and SWD recommendations, and having
determined that a transfer station allows the safe maneuvering,the Director will publish
locations dates and times trailers will be allowed. The Director may suspend this
authorization at any time.
(b) Trailers shall not exceed 6 feet by 9 feet.
(c) All trailers shall have a current County of Hawaii vehicle registration and safety inspection,
proof of which shall be made available upon request by SWD personnel Transfer station
users shall follow all other rules for solid waste disposal and all directions from SWD
personnel.
(d) Transfer station users shall not reverse trailers toward chute.
(e) The Director will notify the public of schedule changes regarding trailers at transfer stations.
