SUBJECT: Proposed Amendment to Bill No. 81, Draft 2; an Ordinance Amending Chapter 2,
of the Hawaii County Code 1983 (2016 Edition, as Amended), by Adding a New
Article to Implement a County Transient Accommodations Tax.
Please see below a proposed amendment to Bill No. 81, Draft 2. This amendment creates a new
section that would allow for a portion of the County transient accommodations tax (TAT) to be
distributed to various departments for mitigation of tourism impacts and TAT management. This
amendment is illustrated in Ramseyer format with respect to the contents of Bill No. 81, Draft 2;
new material is underscored.
SECTION 2 of Bill No. 81, Draft 2, is amended by adding a new section to follow"Definitions"
on page 2, as follows:
"Section 2- Expenditure of funds.
O A-portion of the County transient accommodations tax collected each year shall be
allocated as follows:
$1,000,000 to the department of parks and recreation for the maintenance of
County parks and facilities impacted by tourism;
$250,000 to the department of finance for additional staffing to administer the
County transient accommodations tax program; and
$500,000 to the department of research and development to develop and implement
a program that would manage the impact of tourism on community assets.
Appropriations provided for under this section may be suspended by an emergency
financial declaration by the mayor or by a resolution of the council that is adopted with
at least seven affirmative votes; provided the suspension is for no more than one fiscal
year, unless the emergency financial declaration is extended by the mayor or the
council by adoption of a resolution with at least seven affirmative votes."
A draft copy of Bill No. 81, Draft 3,that would result should this amendment pass is not attached
due to the limited scope of this amendment.
