No. 474/Bill No. 90 <br /> PLACE: Council Chambers <br /> Kailua-Kona, Hawaii <br /> TIME: 1:02 p.m. <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 90, reports as follows: <br /> Bill No. 90, submitted by Mayor Mitchell D. Roth via Communication No. 474, dated <br /> October 21, 2021, amends Ordinance No. 12-33 which reclassified lands from Single-Family <br /> Residential— 10,000 square feet(RS-10)to Residential-Commercial Mixed—20,000 square <br /> feet(RCX-20) at Waiakea, South Hilo, Hawaii, covered by Tax Map Key: 2-2-038:028. <br /> The total area is one acre. The applicant is Takata Dental Health Center, Inc. <br /> The Windward Planning Commission forwards its favorable recommendation for this <br /> amendment, which would allow the applicant a five-year time extension to comply with <br /> Condition B (Time to Complete Construction) and a 180-day extension to comply with <br /> Condition C (Water Commitment). The applicant wishes to relocate its existing dental <br /> practice to the subject property, which is located at 1732 Kilauea Avenue. <br /> Planning consultant, Mr. Sidney Fuke, was present via Zoom to represent the applicant. He <br /> explained that this project has been planned since 2012, but since then the applicant and their <br /> associates have dealt with unforeseen circumstances and need more time to push the project <br /> forward. <br /> Planning Director Zendo Kern was present in the Kona Council Chambers and spoke in favor <br /> of the requested time extension, noting that the department reviewed the entire application to <br /> determine if the intended zoning is still appropriate and to ensure all conditions of approval are <br /> current and relevant. <br /> Committee Chair Ashley Kierkiewicz asked Mr. Kern for clarification on Condition C, to which <br /> Mr. Kern explained that if the property were used for any purpose other than the dental clinic <br /> the Department of Water Supply would have to reassess the water feasibility and commitment. <br /> Chair Kierkiewicz noted that historically there have been many time extension requests from <br /> the Planning Department, and asked if there was a mechanism used to track permits and hold <br /> applicants accountable. <br /> PC Report No.: 35 <br />
