Your Committee on Planning, to which was referred Bill No. 90, reports as follows:
Bill No. 90, submitted by Mayor Mitchell D. Roth via Communication No. 474, dated
October 21, 2021, amends Ordinance No. 12-33 which reclassified lands from Single-Family
Residential— 10,000 square feet(RS-10)to Residential-Commercial Mixed—20,000 square
feet(RCX-20) at Waiakea, South Hilo, Hawaii, covered by Tax Map Key: 2-2-038:028.
The total area is one acre. The applicant is Takata Dental Health Center, Inc.
The Windward Planning Commission forwards its favorable recommendation for this
amendment, which would allow the applicant a five-year time extension to comply with
Condition B (Time to Complete Construction) and a 180-day extension to comply with
Condition C (Water Commitment). The applicant wishes to relocate its existing dental
practice to the subject property, which is located at 1732 Kilauea Avenue.
Planning consultant, Mr. Sidney Fuke, was present via Zoom to represent the applicant. He
explained that this project has been planned since 2012, but since then the applicant and their
associates have dealt with unforeseen circumstances and need more time to push the project
forward.
Planning Director Zendo Kern was present in the Kona Council Chambers and spoke in favor
of the requested time extension, noting that the department reviewed the entire application to
determine if the intended zoning is still appropriate and to ensure all conditions of approval are
current and relevant.
Committee Chair Ashley Kierkiewicz asked Mr. Kern for clarification on Condition C, to which
Mr. Kern explained that if the property were used for any purpose other than the dental clinic
the Department of Water Supply would have to reassess the water feasibility and commitment.
Chair Kierkiewicz noted that historically there have been many time extension requests from
the Planning Department, and asked if there was a mechanism used to track permits and hold
applicants accountable.

Mr. Dern responded that there is currently no formal tracking system in place, but he agrees that
it would be a smart tool and noted that the Department was working on something.
Committee Member Sue Lee Loy agreed with Chair Kierkiewicz, and voiced her support for a
system to track applicants and project timelines.
The vote was then taken on the motion to move this measure to Council with a favorable
recommendation and passed with 9 "ayes."
Your Committee on Planning is in accord with the purpose and intent of Bill No. 90, and
recommends its passage on first reading.
