RE: WAIAKEA CENTER SEWER
Dear Mr. Arakaki:
Sometime ago, the Council authorized the Mayor to enter into a settlement of the claim
made by the developers of Waiakea Center, that their rights to the due process of law had
been infringed by the amendment of the formula, by which private developers of sewer
extensions are reimbursed for their expenses.
The Mayor has questioned whether or not the Council has been made aware of the
financial ramifications of your decision, as illustrated by the exhibit of September 20,
1999 prepared by the Department of Public Works.
For this reason, I am respectfully requesting that this matter be re-agendized to further
discuss this matter. Since, this consultation involves the discussion with us, of a matter
that may result in litigation, I am further requesting that this discussion be held in
Executive Session.
