Re: Resolution for multi-year agreement
The Mass Transit Agency seeks to enter into a one-year lease agreement with payments
of funds from the appropriations of a later fiscal year to utilize commercial space at
Queens' Marketplace in Waikoloa. The leased space will allow for the parking of up to
ten buses and provide a breakroom and rest area for Hele-On bus operators.
Enclosed is a resolution authorizing the County to enter into a one-year lease agreement
with ABP Waikoloa LLC, for approximately 1,211 square feet of commercial space.
The Mass Transit Agency requests that this resolution be waived from Finance
4 Committee and placed on the January 5, 2022 Council agenda due to time constraints. If

A. REQUEST:
Please prepare a resolution to allow for a multi-year contract with ABP Waikoloa LLC to lease space at
Queens Marketplace for Hele-On bus operators to have a breakroom and to park up to 10 buses for Routes
70, 80 and 90. Request ti waive Finance Committee to enter into lease.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
For several years, the contracted bus operators driving Hele-On bus service transport passengers from East,
North and South Hawai'i to Waikoloa Resorts. Once they get to Waikoloa Resorts, they wait inside their
buses for upwards of 7 hours before returning back. For the health and welfare of these bus operators, staff
has negotiated space to provide a rest area for the contracted bus operators. The County would enter into a
12-month lease with ABP Waikoloa. It is envisioned that in a future request for proposals, it would be the
responsibility of the contractor to provide a space at Waikoloa Resorts for their bus operators. The
contractor, Roberts Hawaii will provide all associated furnishings for the leased space.
The proposed lease terms are as follows: Base rent: Year 1:Year 1: $1,598.52 per month, plus GET and
common area operating expense from using the facility of$2,639.98 per month. Additionally, the County will
be responsible for paying associated utilities of electricity through Hawaiian Electric. Restrooms will be
available through the common area use. Attached is the proposed non-binding letter of intent.
This amount is available in the Mass Transit Agency budget through the use of GET in account
025.311.5315.02.115 for the rent of the property and 025.311.5315.02.114 for the electricity.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
