COUNTY OF HAWAII STATE OF HAWAII <br /> qrF OF NP,�6 <br /> RESOLUTION NO. 294 22 <br /> A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS FROM THE <br /> APPROPRIATIONS OF A LATER FISCAL YEAR FOR A LEASE OF REAL <br /> PROPERTY FOR THE COUNTY OF HAWAII MASS TRANSIT AGENCY <br /> WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other <br /> obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one <br /> fiscal year be approved by resolution; and <br /> WHEREAS, the Mass Transit Agency desires to lease approximately 1,211 square feet of <br /> commercial space situated at Queens' Marketplace, 69-201 Waikoloa Beach Drive, Waikoloa, Hawaii <br /> 96738, from ABP Waikoloa LLC ("Landlord"); and <br /> WHEREAS, this space will allow for the parking of up to ten(10) buses and provide a <br /> breakroom and rest area for Hele-On bus operators; and <br /> WHEREAS, the Mass Transit Agency desires to enter into an agreement that is anticipated to <br /> commence on January 1, 2022, for twelve (12) months with Landlord; and <br /> WHEREAS, the Mass Transit Agency is requesting authorization for the Mayor to enter into a <br /> one-year lease agreement with payments of funds from the appropriations of a later fiscal year; now, <br /> therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant <br /> to section 10-11 of the Hawaii County Charter, the Mayor is hereby authorized to enter into a one (1) <br /> year lease agreement for the Mass Transit Agency as indicated above. <br />
