Your Committee on Planning, to which was referred Bill No. 99, reports as follows:
Bill No. 99, submitted by Mayor Mitchell D. Roth via Communication 548, dated November 15,
2021, amends Ordinance No. 11-73, which reclassified lands from Agricultural—forty acres
(A-40a) Agriculture—five acres (A-5a) at Pu`ukapu, South Kohala District, Hawaii, covered by Tax
Map Key: 6-4-017:042. The total area is approximately 17.88 acres. The applicant is Cynthia Foster.
The Leeward Planning Commission forwards its favorable recommendation for this amendment,
which requests a five-year time extension to comply with Condition C (Time to Secure Final
Subdivision Approval) with an amendment to Condition J(Inadvertent Cultural/Historic Finds).
The property is located along the north side of Mamalahoa Highway approximately 750 feet west of
its intersection with Kipahele Street in Waimea.
Planning Consultant Sid Fuke appeared in Hilo Chambers to represent the applicants. He explained
that Mrs. Foster would like to subdivide the land into three parcels, two of which would be for her
children, who live on island, and the third would be sold to offset development costs.
One of Mrs. Foster's children is coordinating the subdivision application but ran out of time to
secure final subdivision approval for a couple of reasons —previous surveyor moved off island and
a new one needed to be secured, and Mrs. Foster's son is juggling this process on top of running a
coffee farm. Mr. Fuke noted that significant progress had been made, including receiving tentative
subdivision approval in October 2020, and that a five-year time extension would be ample time to
complete the project.
Deputy Director Jeff Darrow was present in the Hilo Chambers to answer questions and provide
further background.
Committee Member Holeka Inaba asked Mr. Fuke when he would anticipate the project being
completed, and Mr. Fuke responded that it should only take a few more years for modest
infrastructure improvements.

Committee Member Maile David asked what concerns the State Historic Preservation Division
(SHPD) had regarding Condition J, and Committee Chair Ashley Kierkiewicz replied that the
parcel used to be a grazing field and that the State wanted to monitor the activities by the applicant
as no data was on record at SHPD regarding cultural or historical features.
Committee Chair Kierkiewicz noted that this is a straightforward request for a time extension,then
asked Mr. Darrow about a technicality regarding whether the application should include a statement
about coming back before Council if the time extension deadline is not met. Mr. Darrow said that it
is between the Commission and the Department and that they include that statement on a case-by-
case basis.
The vote was then taken on the motion to move this measure to Council with a favorable
recommendation and passed with 9 "ayes,"
Your Committee on Planning is in accord with the purpose and intent of Bill No. 99, and
recommends its passage on first reading.
