APPROVAL OF AGENDA CM Kimball: Amendment - item added under new business to include HT county resolution in the approval of the HSAC package lies 263 Approved. III. MINUTES a. November 23, 2021, Executive Committee Meeting Minutes approved. IV. REPORTS a. Treasurer's Report T'reasurer's report accepted for audit. CM King: how much have we saved doing virtual meetings, and compare it to previous years. How much have we saved in greenhouse gasses? b. County Reports: ■County of Hawaii CM Kimball: HI county passed the HSAC legislative package yesterday, only comment was to revisit the TAT bill to keep the collection within the county. Also passed a resolution to get 3 positions with the collection within HI county. Officially passed the second reading for the TAT bill Presentation by administration on legislative priorities which does include waste water legislation still in the negotiation process, hope HSAC can support when we get to the final version. ■County of Kauai CM Chock: Also passed the HSAC legislative package in its entirety - some concerns shared. ■County of Maui CM King: Mayor signed into law the chemical sunscreen ban into law, taking effect Oct 21, 2022 - already signs at the airport for the state ban. DLNR is in full support, they are organizing student ambassadors in support of this new law. Will help design a glass case at the airport to educate on this bill. Also working on getting the word out globally. Asked to do an interview with Vogue magazine, to get the word out nationally to start standing up for our environment. aina kupuna bill also signed into law - gives property tax relief for lands that have been in local families for generations. For the last 80 years. As people are losing their generational lands because of high property values. Groundbreaking tax relief. Now law. Last Friday did pass the moratorium law. Second and final reading on the moratorium. Last one was vetoed by the Mayor. Passed Dec 3. Passed first reading on West Maui community plan. Tamara Paltin - is her district, great job at shepherding through. Good ordinance. Overview of COP26will be looking at locally determined contributions. What are we doing in the islands locally? CMKimball: Trying to emulate the sunscreen ban. CM King. Suggest doing a presentation at the conference, can bring articles and present. Suggestion to do an amnesty trade. ■City and County of Honolulu CM Waters: Had the last full council meeting of the year on Dec 1. Passed out the HSAC leg package unanimously. Passed at 6-3 vote Bill 40, little controversial because dedicated half of that to rail. Passed the Oahu general plan on Dec 1. Last general plan was 20 years old. Introduced Bill 48 with Radiant Codero - would create a city permit if you want to do underground fuel tanks. May be preempted by state law. We're not going to have any hearings this year, but now we're going to have one special this year. Looked up US Code Title 42 that says Feds must adhere to state and even local ordinances. CM King:Idea to propose underground permits in all counties. CM Kimball: Good idea to consider for next legislative package CM King: Heard that the sunscreen industry will lobby the state legislature to preempt Maui counties law. Trying to get the info out nationally and internationally. c. NACo Report CM KipuKai: Tim went to the D.C. meeting. Forwarded the policy info today to all members -mainly policy priorities - 11 final policy priorities that NACo board approved. Will be final for 2022. Maintain election safety, enhance community resilience,promote workforce development opportunities. At the conference we will start the process to look at legislative priorities. The committees review in Feb, then again in July and then finalized in Dec. Deadline to get resolutions to be heard by committees is Feb. Also sent a 20 page document with key information from the board meeting. Info on the recently passed infrastructure and jobs act. Significance of the funding. $550B in investments for five years, fiscal year 22-26. Big deal as congress always struggled with trying to get this reauthorized one year at a time. 3 December 9, 20219 HSA.0 Meeting Agenda Page ( 4 ytpTE ASSO w w S i ORfOUNtt CM Waters: NACo is the biggest advocate, will meet one on one to explain bills and resources for counties. The liaison for the whitehouse was available and explained the funding and how it relates to counties. i CM KipuKai: Reminder to register for the leg conference. Last day represents when all the different state associations get together and go to the hill. 3 CM .King: Was there any discussion about getting funds to counties with less than 500,00 population. Did not happen with the CARES act money, had to go through the state. Counties want to get the money directly. Is NACo still pushing for that? I CM KipuKai: Think NACo is working on that. There was additional monies allocated straight to the counties and each county got $.10111 regardless of the population. Recommend to send any questions and will work on getting a response from NACo. CM Kimball: Suggest inviting a NACo representative to speak at one of our meetings. May not be able to invite other council members, due to sunshine law. Could have the alternates present. CM KipuKai: To look into how many are allowable under the sunshine law. NACo would provide info on federal policies. CM Chock:All meetings are open to the public. j CMKing. Is this a good forum to create resolutions for NACo? CM Chock: It is possible to do so if we are in alignment, but if you have something coming from one of the committees, have seen co-sponsors from other counties for each resolution. CMKipuKai:Invite someone to give a federal legislative update. CM Chock: Regarding treasurer's report, wanted to make note to see the line item amendment for the executive assistant. d. WIR Report CM King: Did not attend, but Axel did. Topic was build back better, issues on the west coast, forest fires. Concern about the amount of drilling on public lands. Axel: Bureau of land management released a report but the WIR members gave push back on the report. CM .King: Recommend an agenda for the meetings with congressional members, every county was allowed to speak to their priorities. We can set up a virtual meeting if they are not available in person. CM Chock: Suggest reaching out to get a list of priority items to discuss from each county and then we can present to Congressional members. Also the makana that we usually give, need to coordinate what we will be bringing in and who is bringing what. Will look at the list from the last NACo conference. Also invite some of the members of NACo to an HSAC dinner. NEed to agree on what we want to do.Would I limit what HSAC pays for. CM King: Concern to be frugal with spending a look at setting a budget for what we will spend in D.C. CM Kimball: suggests we think about a policy so it is ongoing and consistent for the long term. CM King: Nahe can you find out how many candidates there are for NACo president. In the past C.M. Chock:Nahe has been in discussion to look at attending D.C. open to discussion on identifying if we have the funding to support the cost of travel. EA: Cost would be $800 in expenses to attend. CM Chock:Motion to approve travel expenses for EA request. CM Waters: We have $14,000 in the account remaining so resources are available. CM Kimball: Propose revised budget, approve expense from HSAC account up to a certain amount. CM Chock: In the past HSAC has covered the makana, this year each county will be responsible for bringing their own. Recommend considering this in the future budget. .Recognize that we have the funds but we have been operating at a deficit so we are approaching this in a frugal manner. CM Waters:Are there opportunities to get sponsorship outside of the conference. CM King. Yes, but we would have to show value. Can Nahe put together something to show the value of expressing our county's concerns. CM Kimball: Is there an event with tables where we can present the conference as an opportunity for them to sponsor. CM Chock: There are meetings when we are there where other counties show how they raise funds and Nahe can attend and look at that. We are 501 c 3, which is important to how we receive funds. Can work with Nahe on ideas around this. i CM Chock: $1200 in expenses for EA to attend NACo legislative conference approved. e. Executive Assistant Report EA: The slate of officers needs to be approved by each county. Have been meeting with each EC member, recently met with CMKing to talk about past experience on HSAC, future goals, who best to contact in your office, and how will the EA role support. 3 CMKing: Next week Friday the slate of officers is being scheduled. 3 EA: We are meeting on Fridays to review the testimony in support of the HSAC legislative package. Important discussions to ensure we are all in line with the j amendments proposed in testimony in advance of session. Need each county to attend either the EC member or a representative. 3 I Will be working closely with everyone on the NACo preparations. Lobbyist Jon Okudara: Has been looking at the TAT bill, the position might be to repeal the 3% limit. CM Waters: On HP.R radio, called 862 gut and replace award. Heard concern is about the legality of 862 and they want to fix it. Lobbyist: Will find out when going to the Capitol next week for some meetings. CM King: How do you approach lobbying if you have a conflict? Lobbyist: Would decline representation. CM Chock: General support for Juneteenth, wondering if it should be switched out with another day. TAT - Kauai is set with their administration on this and wants to be careful how this is approached. Can we clear out some of the bills earlier so we can tighten up what the amendments might be ahead of time. Suggestion to put it in front of the full council. Part of the balance we are looking for is improving credibility and narrowing our priorities should be considered for next year. CM Chock: Motion to receive all reports, motion passed. Communication (11/23/2021) from County of Maui Resolution No. 21-181. APPROVING PROPOSALS FOR INCLUSION IN THE 2022 HAWAII STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE. 3. I did send you all a reminder email on the 3 Hawaiian homesteader bills from 2021 that are back for 2022 that I put forward a while back for inclusion with the HSAC legislative priorities. I learned from the House's Chief Clerk's office that all the bills will be coming back with the same numbers and same co-sponsors. They are: SB 891 / HB 1123; SB 884 / HB 1124; SB 892 / HB 1122 Happy Holidays!!! CM Chock: Spoke to the Senate President, who recommended we send them the HSAC legislative package directly. We have talked about the legislative priorities spreadsheet, including carry over bills. We are in a holding pattern. CM Kimball: We had the discussion on the $10 beautification fund it was brought to our attention that Rep. Ilagan is also working on abandoned vehicle bills, we may want to add those to the list. We also have two things in the works, sunshine law defining what is board business ,making it possible to do proff development with a full board, requiring board packets be available 12 hours before the hearing, etc. Informal gatherings means social. Next step is to meet with stakeholders to ensure they are on board. Sen Kouchi and Rep Nakashima to introduce. Can really achieve this year and will be super helpful to clarify what we can and cannot do. CM King: If we can make it more productive, then it is a good idea. CM Kimball: Wanted to discuss the wastewater, meeting next week and will circulate it after. Waiting on feedback from corp counsel. Engaged labor unions on this. CM Chock: Has been attending Rep 7lagan's meetings. They have narrowed down to 4 bills. Waiting to hear back from Chair Aquino on what they agree on. CMKing: Concern about the sunscreen being preempted. CM Chock:Motion to approve final HSAC legislative package. CM King. Asked Nahe to draft a one page doc on HSAC describing the value and what they bring to the various counties. Can use it on future trips. CM Chock: Drafted a fundraising strategy, another item we can look at in a future meeting. CMKing: Can we meet in person? CM Chock: Let us look at the second quarter. VI. QLD BUSINESS } VII.
