Subject: Bill 112 & 115—Kumu Hou at Waikoloa Park Dedication Analysis
This letter is in response to questions raised at the February 8, 2022, County Council Planning
Committee hearing related to the Planning Department's analysis of park dedication
requirements for the Kumu Hou at Waikoloa project.
Based on the preceding, we have the following to offer:
Park Dedication Analysis for the Kumu Hou at Waikoloa Project
Hawaii County Code Chapter 8 Dedication of Land, Article 1. Park Dedication Code articulates
requirements 'of subdividers (defined as, "any person who divides land as specified under the
definition of subdivision or who constructs a building or group of buildings containing or
divided into two or more dwelling units or lodging units. ') to dedicate park land and
improvements for public use, pay an in-lieu fee, or provide land and improvements for private
recreational uses, or a combination thereof.
Section 8-4 identifies exemptions to these requirements, including subsection (a)(1) which states
the requirements in Article 1 do not apply to, "Subdivision of land in any district where the ratio
of acres of public parks and playgrounds within the district and not federally owned, to the
resident population within the district is greater than the minimum ratio of five acres of land for
parks and playground purposes for each one thousand persons;"
For purposes of HCC Chapter 8, Resident Population is defined as, "...the official resident
population as determined by the County department of research and development. It includes

residents temporarily absent, and armed,forces personnel and their dependents. It excludes
visitors present "
According to population records linked from the County of Hawaii Department of Research and
Development, the 2020 Census resident county for the South Kohala Judicial District was 13,131
persons.' Therefore, based on the ratio articulated in Section 8-4, the threshold to determine
exemption from HCC Chapter 8, Article 1 requirements is 65.655 acres of parks and
playgrounds, which is defined in HCC Chapter 8 as, "...areas and facilities used for active or
passive recreational pursuits."
The acreage of non-federal parks and playground areas in the South Kohala District (including
County Park facilities in Waimea and Waikoloa and State Beach Parks) far exceeds 66 acres of
land (for example, the Hapuna Beach State Recreational Area encompasses over 36 acres alone
& County Parks in South Kohala total over 70 acres).
Based on the preceding, the Planning Department determined that this project was exempt from
park dedication requirements articulated in HCG Chapter 8, Article 1.
