SUBJECT: Proposed Amendments to Bill No. 115; an Ordinance Amending Section 25-8-13
(Puak6-'Anaeho'omalu Zone Map), Article 8, Chapter 25 (Zoning) of the Hawaii
County Code 1983 (2016 Edition, as Amended), by Changing the District
Classification From Open(0), Multiple-Family Residential (RM-4), Multiple-
Family Residential (RM-6), Multiple-Family Residential (RM-8) and Village-
Commercial (CV-10)to Project District (PD) at Waikoloa, South Kohala, Hawaii,
Covered by Tax Map Keys: 6-9-008: Por. 013, 022, 025, Por. 029 and 033.
Please see below proposed amendments to Bill No. 115. The proposed amendments are
illustrated in Ramseyer format with respect to the contents of Bill No. 115 (new material is
underscored).
SECTION 2, Condition Z, is amended to read as follows:
"Z. As represented by the Applicant, the Applicant shall cause the development of a
minimum of 140 units of workforce housing on a property identified by TMK: 6-
9-008:032 and/or other properties within the Resort in accordance with mutually
agreeable terms between the Applicant and the County Office of Housing and
Community Development. The Applicant shall also cause the development of
additional units to be constructed provided that the appropriate exemptions are
secured through the approval of a 201H housing development application
pursuant to Section 201H, Hawaii Revised Statutes, and that there are no on-site
archaeological or cultural constraints which would affect the ability of the site or
sites to accommodate these additional units. Comm. No. i,,_

The terms shall be established in a workforce housing agreement and shall include
the Applicant's infrastructure construction and land conveyance obligations and
operational considerations such as tenant income and other eligibility criteria. An
occupancy permit for the first phase of the workforce housing project shall be
obtained no later than issuance of an occupancy permit for any time share unit
within the area covered by this ordinance."

Due to the limited scope of these amendments, a draft copy of Bill No. 115, Draft 2, in its
entirety, that would result if these proposed amendments are adopted, is not attached.
