SUBJECT : Bill 125: AMENDS CHAPTER 4, OF THE HAWAII COUNTY CODE 1983
(2016 EDITION, AS AMENDED), RELATING TO ANIMALS
The Hawaii Police Department supports Bill 125, which seeks to amend Chapter 4, of the
Hawaii County Code 1983, (2016 Edition, as amended), Relating To Animals; with its purpose
to amend and add definitions relating to injuries caused by Dangerous Dogs, revises penalties for
those who are convicted of negligent failure to control a Dangerous Dog, adds provisions for
habitual negligent failure to control a Dangerous Dog, and adds additional penalties for
violations of Dangerous Dogs regulations.
The Hawaii Police Department was consulted and involved in the drafting of the amendments to
the County Code, by Council Member Kierkiewicz, and concur that as a result of recent
incidents involving vicious dogs changes to the existing law is necessary.
The current language in Chapter 4, of the Hawaii County Code, does not provide enough of a
deterrence by way of definitions and/or penalties imposed for incidents involving dangerous
dogs. These amendments seek to address these areas, as well as the subsequent handling of
vicious dogs, by holding dog owners more accountable for the actions of their dogs, yet still
provide protection for owners when reasonable measures are taken to prevent a dog from
attacking.
Thank you for allowing us to provide comments relating to Bill 125 and urge this committee to
approve this ordinance.
