No. 656/Bill No. 134 PLACE: Council Chambers Hilo, Hawaii TIME: 10:31 a.m. Council Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was referred Bill No. 134, reports as follows: Bill No. 134, submitted by Mayor Mitchell D. Roth via Communication 656, dated February 11, 2022, amends Section 25-8-34 (Papa`ikou-Onomea Zone Map), Article 8, Chapter 25 (Zoning) of the Hawai'i County Code 1983 (2016 Edition, as Amended), by changing the district classification from Agricultural—Twenty Acres (A-20a) to Family Agricultural—Two Acres (FA-2a) at Kalaoa, South Hilo, Hawaii, covered by Tax Map Key: 2-7-008:130. The applicants are Garvin and Laura Goode, and the property area is approximately 9.581 acres. Bill No. 134 was introduced by Committee Chair Ashley Kierkiewicz by request. The Windward Planning Commission forwards its favorable recommendation for this change of zone, which would allow the applicant to create a three-lot subdivision of which two would be conveyed to family members for estate purposes, and the third would continue to be used as an approved bed and breakfast operation and existing agricultural activities. The property is located at 27-2365 Hawaii Belt Road, 300 feet west(mauka) of its intersection with Kalaoa Camp Road in South Hilo. Committee Member Heather Kimball disclosed that she lives in close proximity to the subject property and is recusing herself from discussion and decision-making on this matter. Planning consultant Sidney Fuke was present in the Hilo Chambers to represent the applicants, who appeared before your Committee via Zoom. Mr. Fuke explained that the applicants currently have two dwellings and a small farm on their property with a third dwelling under construction. The applicants intend to subdivide the property into three lots so that their children may own each home respectively and expand agricultural activities while continuing using their current home as a bed and breakfast. PC Report No.: 50 PC-50 Page 2 March 8,2022 Committee Member Matt Kaneali'i-Kleinfelder asked Mr. Fuke and Planning Director Zendo Kern about the surrounding property's acreage and access to Highway 11. Mr. Fuke responded that there is an existing easement servicing Kalaoa Camp Road which provides access to the subject property. Maija Jackson, Planner, was present via Zoom and shared that the surrounding properties were zoned Agriculture—20 acres, noting that some properties are nonconforming lots smaller than 20 acres. Mr. Kern responded that that is common throughout the island and clarified that it is legal non-conforming. Committee Chair Ashley Kierkiewicz noted that this is in accordance with the Hamakua Community Development Plan and the General Plan. She asked Mr. Kern to elaborate on public testimony where this was referred to as an unnecessary precedent. Mr. Kern responded that he did not believe this was setting an unnecessary precedent and that it falls in line with the surrounding areas, noting that there is a condition limiting the property to three farm structures. Chair Kierkiewicz voiced her appreciation for the creative use of the oddly shaped property and that she supports the agricultural activities that are happening and are planned for the property. The vote was then taken on the motion to move this measure to Council with a favorable recommendation and passed with seven"ayes," with Committee Member Maile David absent and Committee Member Kimball excused. Your Committee on Planning is in accord with the purpose and intent of Bill No. 134, and recommends its passage on first reading.
