Kierkiewicz, Council Member SUBJECT: Proposed Amendments to Bill No. 115, Draft 2; an Ordinance Amending Section 25-8-13 (Puak6-'Anaeho'omalu Zone Map), Article 8, Chapter 25 (Zoning) of the Hawaii County Code 1983 (2016 Edition, as Amended), by Changing the District Classification From Open(0), Multiple-Family Residential (RM-4), Multiple- Family Residential (RM-6), Multiple-Family Residential (RM-8) and Village- Commercial (CV-10)to Project District(PD) at Waikoloa, South Kohala, Hawaii, Covered by Tax Map Keys: 6-9-008: Por. 013, 022, 025, Por. 029 and 033. Please see below proposed amendments to Bill No. 115, Draft 2. The proposed amendments are illustrated in Ramseyer format with respect to the contents of Bill No. 115, Draft 2 (material to be deleted is bracketed and stricken; new material is underscored). SECTION 2, Condition HH, is amended to read as follows: "HH. The Applicant shall [donate] offer at no cost any of its ownership of that portion of the Kings Highway Foot Trail (SHPD #50-10-10-21173)that bisects the Waikoloa Beach Resort to the appropriate entity of the State and/or Federal Government. Evidence of this offer shall be provided to the Planning Department prior to or in conjunction with the submittal of any Site Plan Approval in the area covered by this ordinance." Due to the limited scope of these amendments, a draft copy of Bill No. 115, Draft 3, in its entirety, that would result if these proposed amendments are adopted, is not attached. Mahalo.
