Chapter ; Sec. 1906,Pub.L. -59,As Amended) Speed Grant 4 T 41S AGREEMENT made and entered into by and between the STATE OF HAWAII by and through its Director of Transportation,hereinafter referred to as"State,"and the Governmental Unit named in this application,hereinafter referred to as"Applicant." WHEREAS,the National Highway Safety Act of 1966(Public Law 9-564)provides Federal funds to the STATE for approved highway safety projects,and WHEREAS, STATE may make said funds available to various state,county or municipal agencies or governments or political subdivisions upon application and approval by STATE and the UNITED STATES DEPARTMENT OF TRANSPORTATION,and WHEREAS,STATE is obligated to reimburse the UNITED STATES DEPARTMENT OF TRANSPORTATION out of its funds for any ineligible or unauthorized expenditures for which Federal funds have been claimed and payment received,and WHEREAS,the above name APPLICANT has submitted an application for Federal funds for highway safety projects. ICERTIFICATION REGARDINGRSUSPENSION Instructions for Lower Tier Participant Certification 1. By signing and submitting this proposal,the prospective lower tier participant is providing the certification set out below and agrees to comply with the requirements of 2 CFR parts 180 and 1200. 2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered an erroneous certification,in addition to other remedies available to the Federal government,the department or agency with which this transaction originated may pursue available remedies,including suspension or debarment. 3. The prospective lower tier participant shall provide immediate written notice to the person to which this proposal is submitted if at any time the prospective lower tier participant learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances. 4. The terms covered transaction, civiljudgment, debarment, suspension, ineligible,participant, person,principal, and voluntarily excluded, as used in this clause,are defined in 2 CFR parts 180 an 1200. You may contact the person to whom this proposal is submitted for assistance in obtaining a copy of those regulations. 5. The prospective lower tier participant agrees by submitting this proposal that,should the proposed covered transaction be entered into,it shall not knowingly enter into any lower tier covered transaction with a person who is proposed for debarment under 48 CFR Part 9, subpart 9.4, debarred, suspended,declared ineligible,or voluntarily excluded from participation in this covered transaction, unless authorized by the department or agency with which this transaction originated. 6. The prospective lower tier participant Ruther agrees by submitting this proposal that it will include the clause titled "Instructions for Lower Tier Participant Certification" including the "Certification Regarding Debarment, Suspension,Ineligibility and Voluntary Exclusion—Lower Tie Covered Transaction,"without modification,in all lower tier covered transactions and in all solicitations for lower tier covered transactions and will require lower tier participants to comply with 2 CFR parts 180 and 1200. 7. A participant in a covered transaction may rely upon a certification of a prospective participant in a lower tier covered transaction that it is not proposed for debarment under 48 CFR Part 9,subpart 9.4,debarred, suspended, ineligible,or voluntarily excluded from the covered transaction,unless it knows that the certification is erroneous.A participant is responsible for ensuring that its principals are not suspended,debarred,or otherwise ineligible to participate in covered transactions. To verify the eligibility of its principals,as well as the eligibility of any prospective lower tier participants,each participant may,but is not required to,check the System for Award Management Exclusions website (htq)s:llwww.sam.gov/). i I s PROBLEM STATEMENT Speed Grant Grant No: 0 i Identify the traffic safety related problem or deficiency that the proposed grant is intended to correct. i i According to the National Highway Traffi c Safety Administration(NHTSA),Hawaii ranks the fifth highest in proportion of speed-related fatal crashes. "Speeding is widespread and commonly accepted within the driving culture(AAA Foundation for Traffic Safety,2016),and excessive speed is a contributing factor in a high proportion of severe crashes. (Ex#1)NHTSA motor vehicle crash data query from 2015-2019 shows that speed was a factor in(65)fatality crashes on Hawaii Island. Speed remains a serious contributing factor in fatal crashes and injury crashes alike.The perception of risk,i.e.,whether the driver perceives that he/she will be caught speeding,is a factor in how well a posted speed limit is followed. Excessive vehicle speed(speed above that for which the roadway was designed,exceeding posted limits or speed too fast for conditions)has severe and often times disastrous effects in a crash. According to the NHTSA speed-related crashes account for 48%of all traffic fatalities from 2015-2019.See(Ex#2) I A study conducted by SSFM International for the Vision Zero working group on Hawaii Island indicated,"Traffic crashes where speed was a factor made up 41%of all fatal traffic collisions. In the state of Hawaii,that percentage is 44%. [Nationally,the average is 28%of all fatal traffic collisions. The percentage for Hawaii Island in line with the state of Hawaii however both are significantly higher than the national average,suggesting a problem throughout Hawaii that should be addressed through education,enforcement and engineering. The highest percentage of speed-related fatalities on Hawaii Island occurred on roads with posted speed limits of 30-35mph(40%). This is true for all fatal traffic collisions on Hawaii Island as well,where 35%of fatal collisions were on roads with posted speed limits of 30-35mph."" SSFM continued,""The higher percentage of fatalities on 30-35 mph roads on Hawaii Island is potentially due to a lower number of road miles that have speeds higher than 25mph. However,Geometrics and design of these roads may be a factor inducing speed."" (Ex#3) from the Hawaii Strategic Highway Safety Plan manual shows the lethality rates of vehicles traveling at 20 mph,30 mph and 40 mph. As expected the higher the rate of speed a vehicle is traveling the more lethal it is to a pedestrian or bicyclist and he greater damage and potential for fatal consequences for vehicle occupants.(Ex#4)State of Hawaii SHSP confirms that Hawaii Island drivers admitted to speeding in the highest numbers in the 35 mph zone where fatalities are most often occuring. (Ex#5)SSFM shows slightly different rates from the study,but does show that the 30-35mph zones have the highest percentages of fatality crashes Contradicting the popular belief that tourist are over represented in fatality crashes,(Ex#6)SSFM showed that 87%of the motorists resided on Hawaii Island. Only 4%were residents of neighboring islands and 61/o were U.S.residents from outside of the state of Hawaii. (Ex#7)SSFM shows that 66%of fatal crashes occurred on State owned roads and 27%ocurred on County owned roads. When contrasted with the fact that only 28%of all roadways on Hawaii Island are owned by the State of Hawaii it would " indicate that the State owned roads are a more probable area for fatal crashes to occurr. Speeding is often affiliated with reckless driving. The Traffic Services Section compiled a list of reckless driving reports associated with particular roadways during 2019. (Ex#8) Shows the locations of Grant Funded Speed Projects. (Ex#9)Shows the roads in each district with high numbers of reckless driving reports. Grant goals should be stated in measurable terms (i.e., a percent reduction), be concise and deal with a speck item, be realistic with a reasonable probability of achievement, and be 3 related to a speck timeframe(a "by"date). How are you going to show effectiveness of your project? What will be the impact of the project on your identiedproblem and goal(s)? Provide details on the method of evaluation. For on going projects that have beenfimdedfor more than one year, also provide data to show what the project has accomplished over the course of the years. TSS will compare fatality rates over the four year average as identified in the Grant Goals and determine if a decrease in speed related fatalities of at least 1 occured.TSS will track the number of citizen interactions during speed operations from 2100 to 2340 and report that to the district commanders and DOT in monthly CALEA Traffic Trends Reports.
