RESOLUTION NO.
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LICENSE
AGREEMENT OF REAL PROPERTY FOR THE COUNTY OF HAWAII DEPARTMENT
F PARKS AND RECREATION WITH THE ST. JUDE'S EPISCOPAL CHURCH
LOCATED AT 92-8606 PARADISE CIRCLE, HAWAIIAN OCEAN VIEW ESTATES, IN
`IJ, HAWAII.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution; and
WHEREAS, the Department of Parks and Recreation ("Parks") desires to enter into a License
Agreement with the St Jude's Episcopal Church for the use of its premises located at 92-8606 Paradise
Circle, Hawaiian Ocean View Estates, Ka`u, Hawaii, on Mondays, Wednesdays and Fridays from
8:30 a.m. to 12:30 p.m., excluding legal holidays, for the purpose of the County of Hawaii Elderly
Activities Program, Adult Nutrition Services; and
WHEREAS, the License Agreement will commence on July 1, 2022 and will end on June 30,
2024 with a monthly fee of$475.00 plus general excise taxes; and
WHEREAS, Parks is requesting authorization for the Mayor to enter into a multi-year License
Agreement with the St. Jude's Episcopal Church as indicated above; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Honorable Mitchell Roth, Mayor of the County of Hawaii, is hereby authorized to enter into a multi-
year License Agreement with the St Jude's Episcopal Church, commencing July 1, 2022, and ending
June 30, 2024.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of this License Agreement.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to:
(1) Mayor Mitchell Roth; (2) Department of Finance; (3) County of Hawai`i Parks and Recreation; (4)
J Yoshimoto, Assistant Corporation Counsel, and (5) the St. Jude's Episcopal Church, Rae Costa,
Operations Manager, 229 Queen Emma Square, Honolulu, HI 96813.
