My name is Scott Fernandez
The purpose of my written testimony today is to oppose all vaccine mandates of any kind and the logic behind my
opposition
First mandates are not laws, they are unconstitutional dictates.
Doctors practice medicine because "medicine" is not an exact science, and these vaccines and the scientists promoting
them have proven that very notion over the past two years, with every new statement that contradicts their previous
statements.
For example, and for frame of reference a list of the ever changing "known" science below
-Fauci said in early 2020 mask don't work, whoops later that year mask all of a sudden work.
-Last year President Biden stated if you get Vaccinated you won't get covid, and you won't transmit it to others.
Whoops now you can still get it,transmit it,and die WITH IT, but now it should reduce the severity of the disease.
- The vaccines are safe and effective, whoops vaccines injuries and death are on the rise, and now you need another
booster shot because the vaccines are so effective.
Traditional vaccines are "one and done" and it prevents you from becoming infected or spreading the disease
These vaccines are a new technology, never used before on humans" MRNA" which is a gene therapy technology,
only used in animal trials before 2020
These vaccines were rushed through FDA approval and have not completed long term studies, and the completion of
phase three trials is expected in the next couple of years.
VAERS " the vaccine adverse and injury reporting system has recorded tens of thousands of deaths and injury from
these vaccines. Its known that VAERS captures less than 10% of all incidence of vaccine injuries, due to its voluntary
nature and difficulty of use. -
Japan's department of health has put warning labels on these vaccines as dangerous, and removed mandates_ Think
how mandates will effect the island economy when the Japanese people decide where in the world they would like to
travel.
The economy: Many citizens of this state because of these emergency orders and mandates have closed their business,
sold their homes and moved to mandate free states where they are now opening new businesses creating jobs, a larger
tax base, and moving on with their lives nrl t

I personally have closed three of our stores in Hawaii, reduced our Hawaii staffing by 40%, and I am currently
returning from a three week tour of Florida, which has no MANDATES of any kind, and where we hope to relocate
our corporate office and open several new stores.

Other concerns and facts: The fact that you can't get either of the FDA approved vaccines, as they aren't available
should concern you_ The fact that the only vaccines you can receive are those authorized under EUA should also be of
concern. Its important to note the legal distinction between the FDA approved vaccines and those vaccines approved
under EUA guidelines as it relates to legal liability.
Legally the FDA and EUA approved vaccines are legally distinct and mutually exclusive from each other. In short if I
you are injured after taking a EUA vaccine, the pharmaceutical companies have no legal liability. However, if you
are injured after receiving a fully approved FDA vaccine, you have legal recourse against the pharmaceutical
companies. Its not hard to understand why you can't find or receive an FDA fully approved vaccine.
In 1776 while our forefathers were fighting for our constitution rights, there was a real pandemic going on " the small
pox" pandemic which had a high mortality rate, 25% across all age groups. The colonists didn't shut down or restrict
access to any businesses, stop the revolutionary war, restrict travel, or require documentation to enter a tavern. They
continued to fight for the very rights we are losing today in Hawaii.
In conclusion, these mandates are unconstitutional, and are based on faulty science, which appears to be based on
money and power. The only vaccine you can recieve is one of the three approved under EUA guidelines, which
neither the federal or state government have the authority to mandate, according the laws surrounding EUA. Further,
the Nuremberg code, written because of the medical experiments performed by the Nazi's upon the jews, is intended
by force of law to prevent any person or government from forcing citizens to comply with medical experimentation
and dictates by coercion or other means
" WHERE THERE IS RISK THERE MUST BE CHOICE"
I love living in Hawaii, but the emergency orders and mandates must be stopped or you will lose the best and the
brightest to other states. It takes courage to do the right thing
