Re: Resolution to grant an easement
Executive order No. 4539 dated November 3, 2017, set aside lands to be under the control
and management of the County of Hawaii, being that parcel of land situated at Waiakea,
South Hilo, Island, and County, and State of Hawaii for the combined public purposes of
a veteran's center and affordable senior housing with preference to veterans and spouses.
Enclosed is a resolution authorizing the Director of Finance to grant HKI Kawili, LLC a
perpetual nonexclusive easement for access and utility purposes to Tax Map key No. (3)
2-4-057:031.
The Office of Housing and Community Development request that a breach be authorized
to submit this resolution after the March 31, 2022 submission deadline, and to waive it
from the Finance Committee in order to be placed on the April 20, 2022 Council agenda.

A. REQUEST:
The Office of Housing and Community Development (OHCD) is requesting a resolution authorizing a
declaration of non-exclusive access and utility easements on portions of Ululani Street, and Olona Street in
Waiakea, Hawaii, for an affordable senior housing project with preference for veterans and their spouses
pursuant to Hawaii County Code Section 2-120(a)(4)which allows for the disposition of real propoerty by
granting easements to afffordable housing developers on terms and conditions that relate to affordable
housing from the County of Hawai'i.
OHCD is requesting to waive Committee because of the time constraints for the project to complete the final
funding process for their Low Income Housing Tax Credits(LIHTC) and Rental HousingTrust Fund project
which is slated to commence building in June 2022.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
On October 21, 2020 Resolution No. 733-20 designated the HKI Kawili LLC, an affiliate of EAH Inc dba EAH
Housing, the developer of the West Kawili Street Senior/Veteran Housing Project, an independent living
facility with housing units and a community center as a HRS 201 H project exempt from certain codes, code
requirements and standards. This resolution will promote the construction of 92 affordable housing units.
The attached resolution will allow the HKI to access their parcel with road and utilities necessary for the
project.

Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
