1.A legacy for Waikaloa Land Company? What about a legacy for all of West Hawaii ?
2.The 2%to the trust is not legally enforceable, by the trust itself, its trustees or vague beneficiaries, particularly if the project is
sold. The massive density of this new project cries out for fair share contributions. TO resolve these two issues,and make the 2%
"legal", ASSESS 2%AS FAIR SHARE CONTRIBUTION FOR THE COUNTY, WHICH MAY BE PAID/SATISFIED BY PAYMENTTO THE TRUST.
The residential lots too.This way it gets paid and can withstand any Houkulia style attack attempt or the trust chooses or is forced
not to pay.
3.The to-be-clogged public intersection at Queen Kaahumanu Highway must be improved and made safe before any Certificate of
Occupancy. Traffic studies and improvements to the resort's internal roads would remain as requirements.
4. Parks (and open space?) must clearly be made PUBLIC and thus freely accessible. And there should be a bigger or more public
parks, improved,with ball/soccer fields for the PUBLIC.
S. More affordable housing,actually built* -"work force housing" is only for the project's benefit,shouldn't count, and isn't enough
for present and/or future employees. The situation will otherwise only get worse.
*Developers should be required to BUILD affordable housing, an not escape affordable housing requirements by merely
contributing land to the County and then watching the situation get worse. The County already has huge amounts of vacant
affordable housing land. The County appears to be incompetent or unable as to utilizing its huge amount of land for affordable
housing. Thus a PRIMARY CAUSE OF THE AFFORDABLE HOUSING PROBLM ISTHE COUNTY ITSELFII.
6.A"proposal"or"intention" is not a legally enforceable commitment. It is a way to sound good, but the applicant and/or its
successor/buyer avoiding an obligation and the Council being fraudulently misled at the public's expense.
