A RESOLUTION AUTHORIZING TI CT OF FINANCE TO ENTER INT
NEGOTIATIONS FTHE ACQUISITION OF TAS MAP KEY (3) 7-7-004:025
SITUATED INT E DISTRICT OF NORTH KONA,ALSO N AS KAKALA
KAMOA CULTURAL CENTER, UTILIZING THE PUBLIC ACCESS, OPEN SPACE,
AND NATURAL RESOURCES PRESERVATION FUND.
WHEREAS, in 2005, the Public Access, Open Space, and Natural Resources
Preservation Fund was established by Ordinance No. 05-85, as codified in Chapter 2, Article 42,
of the Hawaii County Code 1983 (2016 Edition, as amended) (hereinafter"the Code"); and
WHEREAS, Section 2-214.1(c) of the Code provides that the Public Access, Open
Space, and Natural Resources Preservation Fund shall be used for acquiring lands or property
entitlements in the County of Hawaii for the following purposes:
"(1) Public outdoor recreation and education, including access to beaches and
mountains;
(2) Preservation of historic or culturally important land areas and sites;
(3) Protection of natural resources, including buffer zones;
(4) Preservation of forests, beaches, coastal areas, natural beauty and agricultural
lands; and
WHEREAS, Section 2-217 of the Code provides, in part, that a duty and responsibility
of the Public Access, Open Space, and Natural Resources Preservation Commission(hereinafter
"the Commission") is to develop and submit to the Mayor an initial list of qualifying lands
worthy of preservation and to update the list at any time, but at least annually by December 31 of
each year; and
WHEREAS, Kakala O Kamoa Cultural Center is included on the prioritized list of lands
to be considered for acquisition as priority number 16, as submitted by the Commission in its
2021 Annual Report to the Mayor dated December 10, 2021 (see "Exhibit A", attached hereto);
and
WHEREAS, Kakala O Kamoa Cultural Center, located in the district of North Kona, is
approximately .78 acre and is significant to the County of Hawaii for the following reasons:
(1) Acquisition would preserve historic and culturally important lands and sites that
promote preservation and perpetuation of native Hawaiian culture,tradition, and
customary practices; and
(2) Acquisition would fulfill the purpose of protecting one of the few remaining open
space properties in this area along Alii Drive; and
(3) Acquisition would provide access for cultural practices, shoreline gathering, fishing,
surfing, and recreational use to residents and visitors to connect with the `aina; and
WHEREAS, the property is currrently listed for sale and the owner is willing to
participate in the PONC process for a preservation sale to the County of Hawaii; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
pursuant to Chapter 2, Article 42 of the Code, the Director of Finance is hereby authorized to
enter into negotiations for the acquisition of tax map key (3) 7-7-004:025, also known as Kakalo
O Kamoa Cultural Center, an oceanfront parcel located on the north side of Holualoa Bay along
Alii Drive, adjacent to "L,ymans" a popular surfing spot in the district of North Kona, utilizing
the Public Access, Open Space, and Natural Resources Preservation Fund.
BE IT FURTHER RESOLVED that the Director of Finance is hereby authorized to
initiate any funding mechanisms required for the acquisition of tax map key (3) 7-7-004:025
situated in the district of North Kona, also known as Kakala O Kamoa Cultural Center, in
accordance with the terms of this resolution.

BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable Mitchell D. Roth, Mayor; the Director of the Department of Finance;
and the Public Access, Open Space, and Natural Resources Preservation Commission.

This oceanfront parcel is located on the north side of Holualoa Bay along Alii Drive, adjacent to
`Lyman's' a popular surfing spot. Situated on the property and built in the 1950's is the historic
Lyman House, a small guest cottage and stone swimming pool.
Anticipated Use
• Repair and restoration of existing structures to provide the community with a cultural
educational center/museum.
• Coastal area used for subsistence fishing, shoreline gathering. swimming, surfing, etc.
Significance and Management
• Betty C. Kanuha Foundation. a 501(c)(3) that has been supporting literacy and cultural
programs for 20 years. has expressed interest in stewardship and maintenance if
acquired by the County.
• National Register of Historic Places. Holualoa 4 Archaeological District (State Site No.
50-10-37-23. 661)

• The property is currently listed for sale and owner is willing to participate in the PONC
process for a preservation sale.
