RESOLUTION AUTHORIZING THE DEPARTMENT OF PUBLIC WORKS TO AWARD FUNDS TO THE PEOPLES ADVOCACY FOR TRAILS HAWAII
WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawai‘i County Code (2005 Edition as amended) states, Grant awards in excess of $25,000 to nonprofit organizations shall
specifically identify the organization receiving the grant funds and the purpose for which the grant funds shall be used in an ordinance or resolution; and
WHEREAS, Chapter 2, Article 25, Section 2-136(5) of the Hawai‘i County Code states, “nonprofit organization” means an organization organized for other than profit-making purposes and
which has a current 501(c)3 tax-exemption from the Internal Revenue Code; and
WHEREAS, the Peoples Advocacy for Trails Hawai‘i (PATH), which qualifies as a nonprofit organization as defined above, will expand the Bikeshare system within the County of Hawai‘i;
and
WHEREAS, the Department of Public Works wishes to provide $907,500 to the Peoples Advocacy for Trails Hawai‘i; and
WHEREAS, the grant funds will be used towards the expansion of the Hawai‘i Island Bikeshare system in Hawai‘i County by increasing the number of stations in Kailua-Kona and Hilo; now,
therefore
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I, in accordance with Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawai‘i County Code, the Department of Public Works is
authorized to provide a grant of $907,500 to the Peoples Advocacy for Trails Hawai‘i to expand the Hawai‘i Island Bikeshare system.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai‘i shall transmit copies of this resolution to the Office of the Mayor, the Finance Department, and the Department
of Public Works.
