Department of Transportation regarding the above-referenced application. As is clearly shown
by the date of the email transmittal, the Planning Department did not receive the letter until
April 22, 2022; therefore, it was not available to the Leeward Planning Commission at its
April 21, 2022, hearing on the subject application.

Subject: Change of Zoning Condition Amendment(REZ2022-000015)
Kaloko Mauka Subdivision (Ordinance 06-82)
State Mamalahoa Highway, Hawaii

Thank you for your letter dated February 10, 2022, and the opportunity to review the request to
amend the zoning conditions. The application was approved in 2006 to allow the rezoning and
subsequent subdivision of a 21-acre Agricultural-zoned lot into 7 Family Agricultural-zoned lots.
The Petitioner requests to amend the subject ordinance to allow an additional 5-year time
extension under Condition D, and Conditions E and F related to easements for a forest reserve.
The amended request also includes the proposed removal of Condition J related to traffic
improvement, which states that:
"Building permit for a residence will not be issued until improvements to the intersection at
Mamalahoa Highway and Kaloko Drive are completed,provided that if the improvements are
not completed within 24 months of the date of adoption of this ordinance, the Applicant shall be
allowed to proceed with the building permit. The improvements may include the following:
1)illuminate intersection at night; 2) installation of traffic signalization devices; 3) channelize
turning movements at the intersection; and4)provide other safety improvements, including
appropriate line of sight distance requirements, as may be required by the State Department of
Transportation."

The County of Hawaii (County) is responsible for the improvement plans of the intersection of
State Mamalahoa Highway and Kaloko Drive. The County has collected the fair share funds
from the landowners. Therefore,the Hawaii Department of Transportation(HDOT) does not
have any objections to the removal of Condition J.
The County should coordinate the traffic improvement plans with our HDOT, Highways
Division, Hawaii District Office.
