A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL PROPERTY FOR THE COUNTY OF HAWAIʻI DEPARTMENT OF
ENVIRONMENTAL MANAGEMENT
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution; and
WHEREAS, the Department of Environmental Management desires to lease approximately 3,163 square feet of office space situated at Hanama Place, in Kailua-Kona, County and State of Hawai‘i,
from Puna Plantation Hawai‘i, Limited (“Landlord”); and
WHEREAS, the Department of Environmental Management desires to enter into a multi-year lease agreement that is anticipated to commence on July 1, 2022, for four (4) years and eleven
(11) months with Landlord; and
WHEREAS, the Department of Environmental Management is requesting authorization for the Mayor to enter into a multi-year lease agreement with Landlord for office space; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that pursuant to section 10-11 of the Hawai‘i County Charter, the Mayor is hereby authorized to enter into a four (4) year and
eleven (11) month lease agreement for the Department of Environmental Management Kona office as indicated above.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to: (1) Mayor Mitchell D. Roth; (2) Department of Finance; and (3) Department of Environmental Management.
