Rezoning Request and State Land Use Boundary Amendment
Orchid Gardens

The Planning Commission, after a duly held public hearing on
September 27, 1988 voted to recommend for your approval the
attached legislative bills to change the State Land Use district
from the Agricultural to the Urban District and the County zoning
district from an Agricultural 10-acre (A-10a) to a Single Family
Residential - 15, 000 square foot (RS-15) zoned district for
approximately 13. 74 acres of land at Waiakea Homesteads, 2nd
Series, Waiakea, South Hilo, Hawaii.
The Commission concurs with the following Planning Director' s
reasons for initiating the change of zone :
The approval of the reclassification from the State Land
Use Agricultural to the Urban District, as well as the.
rezoning of the property from an Agricultural 10-acre (A-10a)
to a Single Family Residential-15,000 square foot (RS-15)
zoned district, will not be violative of Section 205-2,
Chapter 205, Hawaii Revised Statutes, nor will the
reclassification actions be inconsistent with the Hawaii Land
Use Commission Rules, the County General Plan and the Hawaii
State Plan.
The request conforms to the LUPAG Map of the General
Plan which designates the property for Alternate Urban
ansion

The LUPAG Map component of the General Plan is a
representation of the document' s goals, policies, standards '
and courses of action. It is also a graphic depiction -of the
physical relationship between various land uses. The LUPAG
Map establishes the basic urban and non-urban form for areas
within the County. The area under consideration is
consistent with the urban form established for this section
of the City of Hilo as depicted on the LUPAG Map.
The property is situated within close proximity to the
major employment and government center of the island of
Hawaii . As such, it is at a location which will complement
the Land Use Commission Rules which states that in
determining the boundaries for Urban District, "It shall
include lands characterized by 'city-like ' concentration of
people, structures, streets, urban level of services and
other related land uses ," "Proximity to centers of trading
and employment facilities ® . . ," and "proximity to basic
services such as . . . schools , parks , and police and fire
protection. " The request will also conform to the Land Use
and Residential elements of the General Plan which basically
state to zone urban-type uses in areas with ease of access to
community services and employment centers and with adequate
public utilities and facilities. The property is provided
with all utilities and services which are essential to
accommodate the proposed development. The applicant has
secured rights to a water commitment to accommodate the
proposed development.
The property has no severe geological or topographic
problems which cannot be properly rectified or which would
render the land unusable for the proposed residential use.
Therefore, the reclassification does meet the standard which
states that lands included within the Urban District
shall be those with satisfactory topography and drainage and
reasonably free from the danger of floods, tsunami and
unstable soil conditions and other adverse environmental
effects. "
While the property is currently within the State Land
Use and County' s Agricultural districts, it is not now
actively used for agricultural purposes. The property was
used for very limited grazing activity. Therefore, as stated
by the State Department of Agriculture, the reclassification
actions will not adversely affect the agricultural resources
of the area.

The proposed land use amendments for the purpose of
creating single family residential lots would also be
consistent with the General Plan Housing goals of providing a
variety of housing choices, as well as attaining a diversity
of socio-economic housing mix within this area of Hilo. The
provision of 15, 000 square foot sized lots, along with other
existing and proposed residential lots in the area would
provide a myriad of► y residential sized lots within this
section of the City of Hilo. Based on the above, it is
determined that byallowingthe
proposed development for the
types of potential clientele, the Housing goals of the
General Plan may be attained for this area of the South Hilo
District.
Furthermore, the proposed reclassification actions will
complement the existing and future residential land use
make-up of the properties in the immediate area; thus,
providing for an orderly residential development of the area.
It should be noted that the reclassification actions
would also conform to the following goals, objectives, and/or
policies articulated in The Hawaii State Plan:
a. (Provide) Greater opportunities for Hawaii' s people to
secure reasonably priced, safe, sanitary, livable homes
located in suitable environments that satisfactorily
accommodate the needs and desires of families and
individuals.
b. (Provide for) The orderly development of residential
areas sensitive to community needs and other land uses.
c. Effectively accommodate the housing needs of Hawaii ' s
people.
d. Increase home ownership and rental opportunities and
choices in terms of quality, location, cost, densities,
style, and size of housing.
e. Promote design and location of housing developments
taking into account the physical setting, accessibility
to public facilities and services, and other concerns of
existing communities and surrounding areas.
f. Facilitate the use of available, developable, and
underutilized urban lands for housing.

Finally, it should be noted that within the City of
Hilo, there currently are very limited larger sized lots
classified Urban by the State Land Use Commission which can
be developed immediately for residential purposes . The
inventory of vacant urban and residential zoned lands are
very limited, particularly within the Waiakea Homestead area
of the City of Hilo. Therefore, there is a definite demand
for reclassifying additional lands to accommodate the housing
needs for the residents of Hilo and surrounding communities.
The redesignation of the subject property could partially
satisfy this need.
Based on the above discussion, it is determined that the
granting of the State Land Use district boundary amendment
and change of zone requests would result in an appropriate
land use pattern that will further the public necessity and
convenience and the general welfare.
For your favorable consideration, an amendment to the State
Land Use Boundaries map and Section 25-114, the City of Hilo Zone
Map, of the County Zoning Code is transmitted.

SECTION 1. Section 25-114 , Article 3 , Chapter 25 ( Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of property described hereinafter as
follows : •

SECTION 2. This change in district classification is
conditioned upon the following: (A) the applicant, successors
or assigns shall be responsible for complying with all of the
stated conditions of approval; (B) subdivision plans shall be
submitted for tentative approval within one year from the
effective date of the change of zone. Final subdivision
approval shall be secured within one year from the date of
receipt of tentative subdivision approval; (C) a drainage
system meeting with the approval of the Department of Public
Works shall be installed; (D) access to the proposed lots shall
meet with the approval of the Department of Public Works;
(E) all other applicable laws, rules, regulations and
requirements be complied with; (F) an annual progress report
shall be submitted to the Planning Director prior to the
anniversary date of the effective date of the zone change. The
report shall address the status of the development and the
compliance with the conditions of approval . This. condition
shall remain ineffect untilall of the conditions of approval

have been complied with and the Planning Director acknowledges
that further reports are not required; and (G) should the
council adopt a Unified Impact Fees Ordinance settingforth

criteria for the imposition of exactions or the assessment of
impact fees, conditions included herein may, at the applicant ' s
election, be satisfied by performance in accordance with the
requirements of the Unified Impact Fees Ordinance; and, (H) an
initial extension of time forthe performance of conditions
within the ordinance may be granted by the Planning Director
upon the following circumstances: 1) the non-performance is
the result of conditions that could not have been foreseen or
are beyond the control of the applicants, successors or
assigns,' -and that are not the result of their fault or •
negligence; 2) granting of the time extension would not be
contrary to the general plan or zoning code; 3 ) granting of the
time extension would not be contrary to the original reasons
for thegranting of. the change of zone;. 4) the time extension
granted shall be for a period not to exceed the period
originally granted for performance ( i .e. , a condition to be
performed within one year may be extended for up to one
additional year) ; and 5 ) if the applicant should require an
additional extension of time, the Planning Director shall
submit the applicant' s request to the County Council for
appropriate action. Further, should any of the conditions not
be metor substantiallycomplied with in a timely fashion, the
Director may initiate rezoning of the area to its original or
more appropriate designation.

SECTION 3. In the event that any portion of the ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval .

ORCHID GARDENS, INC . : STATE LAND USE BOUNDARY AMENDMENT (SLU 88-1 )
CHANGE OF ZONE (R88-12)
Orchid Gardens , Inc . , has filed a petition to reclassify
approximately 13 . 74 acres of land from the State Land Use
Agricultural to the Urban District . Also requested is a Change of
Zone for the property from an' Agricultural 10-acre (A-l0a) to a
Single Family Residential - 15 ,000 square feet (RS-15) zoned
district . The property is located approximately 1,000 feet mauka or
onthe west side of Kupulau Street, adjacent to and southwest of the
Kahalani. Estates Subdivision, Waiakea Homesteads, 2nd Series,
Waiakea, South Hilo, TMK : 2-4-65 : portion of 2 .
GENERAL INFORMATION
1 . In 1985, the State Legislature amended Chapter 205 , Hawaii
Revised Statutes, allowing the counties to process State Land Use
district boundary. amendments involving land areas of fifteen acres
•
or less, except those . lands within the State Land Use Conservation
District .
2 . As a result of this change to the State Statutes, the
County Council enacted Ordinance No . 86 126 (Chapter 28 ) effective
November 25 , 1986 which sets forth procedures for the processing of
such State Land Use district boundary amendments . This ordinance
also allows the simultaneousprocessing of State Land Use district
boundary amendments with other land use amendments and permits .
3 . In February of 1987 , the Planning Commission adopted its
c-VZOO
Rule No. 13 which establishes specific procedures for the processing
of State Land Use district boundary amendments .
PROPOSED DEVELOPMENT
4 . The applicant intends to create a 35-lot residential
subdivision consisting of 15, 000 square foot size lots . The
applicant intends to market the lots at about $35,000 . The
applicant does not intend to construct any dwelling units on the
proposed lots.
5 . In support of the request, the applicant stated the
following :

COUNTY AND STATE PLANS
6 . The General Plan Land Use Pattern Allocation Guide (LUPAG )
Map designates the property as Orchards and Alternate Urban
Expansion (AUE).. The. Orchard designation refers to those lands
though rocky in character and content may support productive
macadamia nuts, papaya, citrus and other similar agricultural
products .. The .AUE designation allow alternate development patterns
when a) designated urban areas become largely developed; b)
designated urbanareasdevelop too slowly; c ) developers propose to
develop marginally acceptable areas and extend theirown
infrastructure; d ) the potential for urbanization exists via .
non-conforming subdivision; e) new non-contiguous urban clusters may
be desirable; or f ) the urban form of an area has not yet been
determined.

7 . The State Land Use district classification is Agricultural..
8 . The Hilo Community Development Plan (CDP ) initially adopted
by the Planning Commission as its Resolution No . 1 in 1975 suggests
the retention of the A-l0a zoned district .
9 . The property is not within the Special Management Area
( SMA) .
DESCRIPTION OF PROPERTY AND SURROUNDING AREA
10 . The area under consideration is a portion of a 40-acre
parcel . The 13 . 7-acre area under consideration is vacant of any
uses and structures . Two anthurium saran shade structures are
situated on approximately 4 acres of the remaining parcel which is
not part of this petition.
11 .. According to the U.S.D.A. , Soil Conservation Services Soil
Survey Report , the land is of the Ohia (OHC ) and Olaa (OLD) series .
Both soil series consist of well-drained silty clay loam that formed
in volcanic ash. The surface layer of the Ohia soil series is
dark-brown and very dark brown silty clay loam about 9 inches
thick . The subsoil is underlain by unweathered pahoehoe lava at a
depth of about 62 inches . The Ohia soils are used mostly for
sugarcane, pasture and woodland . Small areas are used for truck
crops and orchards . The surface layer of the Olaa soilseries is
very dark brown extremely stony silty clay loam about 16 inches
thick . The subsoil is dark-brown extremely stony silty clay loam
about 9 inches thick . It is underlain by Aa lava. This soil is
usually used for sugar cane .

Permeability rapid,id, runoff is slow, and the erosion hazard is

slight .
12 . The Land Study Bureau ' s overall productivity ratings for
agricultural use are classes "E" (Very Poor ) and "C" (Fair) .
13 . The property is not classified according to the State
Department of Agriculture ' s Agricultural Lands of Importance to the
State of Hawaii (ALISH ) system.
14 . The Flood Insurance Rate Map (FIRM) designates the property
as Zone "C" (Area of minimal flooding ) .
15 . The topography o raphy of, the property is relatively level .
16 ... The average rainfall of the area is approximately 100-175
inches .
1.7 . The adjoining lands are all within the State Land Use
Agricultural District and zonedeitherA-la or A-10a by the County .
The area under consideration abuts the southwestern corner of the
Kahalani Estates Subdivision which consists of 1-acre sized lots ..
The other agricultural zoned lands in the immediate area are in
pastoral use or are vacant .
18 . The lands makai of Kupulau Street, a distance of
approximately 1,000 feet from the subject property, are within the
State Land Use Urban District . These lands have been zoned and .
subdivided into residential sized. lots .
UTILITIES AND SERVICES
19 . Water is available from an 8-inch waterline along Kupulau
Road. The Department of Water Supply has issued a water commitment
to the applicant.

20 . Access to the property from Kupulau Street will be via a
50-foot wide roadway. According to the applicant , the access and
interior subdivision roads will be constructed to dedicable
standards.. Kupulau Street has an existing right-of-way width of
forty feet with a 20-foot wide pavement. According to the City of
Hilo Zoning Map, Kupulau Street is proposed to be widened to an
80-foot wide roadway.
2.1 . This area of the City of Hilo is not serviced by a
municipal sewer system. Cesspools are used as means of sewage
disposal . .
22 . All other essential utilities and services are available to
the property.
AGENCIES ' COMMENTS
23 . Department of Public Works :
"We have reviewed the subject application( s ) and our
comments are as follows :.
"1.. Building shall conform to all requirements of code and
statutes pertaining to building construction.
"2 . All development generated runoff shall be disposed on
site and shall not be directed toward any adjacent
properties. .
"3 .. Applicant shall be informed that if drywells are •
included in the subject subdivision improvements ,
Chapter 23 , Underground Injection Control (UIC) ,
Administrative Rules, Dept . of Health, prohibit any
person from operating, constructing or modifying an

injection well (drywell) unless authorized by .a permit
issued by the Director of Health, State of: Hawaii . • .
Furthermore, should dedication of roadways- including
drywells be contemplated, the Dept . of Public..Works
r will not approve dedication roadways prior: to
compliance with Chapter 23 , UIC, Administrative Rules .
"4 . The entrance roadway shall be. located outside of the
floodway and fringe . "
24 . Waiakea Soil & Water Conservation District (SWCD) :
"We concur with the applicant on soils information and the
drainage assessment described in this request . However ,.
due. to •the uncertainty of Waiakea Streams flow capacity and.
. • accuracy of F .I .R.M. data in this area, it is suggested
that a more detailed drainage study be made for this
.proposed development.."

applicant ' s mentioning that no evidence of historic sites
has been seen (p. 4 ) would match expectations.

will have 'no effect ' on significant historic sites . "

"The County maintains . 54 re recreational facilities ( 552
acres) within the South Hilo District . Facilities within

In that retard, the applicant is requesting that a
portion of the :9 , 146 acre property be reclassified from the
State Land Use Agriculture to the Urban district. The
requested area is 13 . 74+ acres .
Simultaneous with the State Land Use boundary- amendment ,
the applicant is seeking to have the proposed Urban area be
rezoned from the County' s Agriculture (A-10a ) zone district
to the Single-Family residential (RS-15 ) district . The
balance of the property ( 25 . 406+ acres) would remain in the
State Lend Use Agricultural district and the County
Agriculture (A-10a) zoned district.
PROJECT LOCATION
The propertyis an interior lot consisting of 39 . 146
acres situated mauka or west of Kupulau Street and abutting
the proposed Haihai Street extension. Access to the propert--
is through a 50-foot right-of-way originating from Kupulau
Street . Although the property abuts the proposed Haihai
Street extension , no access from this proposed street is
planned.
Lands surrounding the parcel are generally vacant and
undeveloped. The makai side of Kupulau Street is
characterized by single-family residences with lot sizes
ranging from 10 , 000 to 15 ,000 square feet . The area to the
northeast is zoned • for one - acre agricultural lots and
1 contains a 26-lot subdivision referred to as the Kahalani
Estates Subdivision. The balance of the surrounding area is
presently vacant and used primarily for cattle grazing and
drainage purposes . It should be noted, however , that there
was a one-acre rezoning application for that area between the
subject property andkupulau Street that was recently
withdrawn.

The applicant intends to subdivide the northern end of
the property into thirty-five ( 3 5 ) 15 , 000 square-foot
residential sized lots . The remaining 25 . 4+ acre portion of
:he property would be left in its present limited state . The
undeveloped portion has two saran shade structures where the
applicant is raising anthuriums . The applicant ' s long-term
goal is to gradually phase this area out and consolidate his
operations at his present site along E. Kawilani Street .
The proposed subdivision will be fulls- improved with
County s anLaru roadways , water s s Lem. and utilities . The
applicant
'lopes to market the lots at about ,$35 , 000 based
upon 1987 dollars . A low density residential ambience ,
consistent with the surrounding area ( such as the Kahalani
Estates ) is being sought by this development.
INSTITUTIONAL CONSIDERATIONS
State Land Use
The present designation of the subject property is
Agriculture. The lands immediately surrounding this property
are also situated within the Agricultural District , except
for that portion makai of Kupulau Street .
The proposed redesignation may be considered pursuant to
Planning Commission Rule No . 13 , State Land Use District
Boundary Amendments , whereby the Planning Commission is
authorized to redesignate properties with land areas of 15
acres or less .
County General Plan
The General Plan Land Use Pattern Allocation Guide
(LUPAG) Map designates this area for Extensive Agriculture
overlain by Alternate Urban Expansion. As such, this request
would not be contrary to the General Plan LUPAG map .
Zoning Code
The County Zoning for the subject property is A-10a.
This zoning designation allows minimum building sites of at
least 10 acres in size. Permitted uses include single-family
1 dwellings (one per. building site) , all forms of agriculture
uses , home occupations , golf courses , parks and similar
recreational uses , aquaculture , hunting and fishing lodges ,
guest ranches , and accessory uses .

EN _ :0 \,.,E NTAL CONSIDERATIONS
Site Characteristics
A portion of the suhlect property is developed for
anthurium production. Two separate saran shade structures
covering four (4) acres each were constructed in 1981 -82 ,
along with a 10-foot wide rough graded access road to connect
the parcel unto Kunulau Street. The remainder of the parcel
is vacant and unimproved.
P As noted previously , the area of the proposed
residjent_a! subdivision Coes not affect the existing
anthurium operations / structures . Those structures and
activities are located south of the proposed subdivision.
The topography of the site is fairly level and the
average rainfall is over 100 inches annually .
According to the U. S. Department of Agriculture Soil
. Survey Report , soils on the property are primarily of the
pahoehoe variety with pockets of organic matter . These would
be shallow pahoehoe , moderately drained, with an average
slope of 0-35 percent .

This series is characterized by extremely stoney silty clay
loam ( 01D) series . They are well drained, silty clay boars
that formed in volcanic ash. These soils are primarily used
for sugarcane cultivation. However , the natural and existing
vegetation consists of guava, ferns , and "Hilo" grass .
According to the Agricultural Lands of Importance to the
State of Hawaii (ALISH) classification system, the proposed
development area does not appear to be classified.
According to the Land Study Bureau Overall Productivity
Ratings system, the area of the proposed development has a
Class E rating. It does appear , however , that there is
Class C rating over a minute portion of the makai section of
the proposed development.
Vegetation/Fauna
1 The undeveloped portion of the property contains native
vegetation such as guava, "Hilo" grass , and other
miscellaneous grasses and shrubs . There are no significant
trees or other vegetative features on the property.
Common animal species in the area include field mice ,
mongoose , and stray domestic animals such as cats or dogs .
Occassional cattle and horses are sometimes allowed to graze
on portions of the property.

Archaeolo ical Features
There is no evidence of historical or cultural features
on the parcel , nor did the records at the County Planning
Department uncover any significant findings attributable to
the area or subject property.

That portion along the southern edge of the property
(but outside of the proposed development area) is encumbered
by an 80-foot wide drainage easement in behalf of the County
of Hawaii . This drainageway is part of the Waiakea-Uka Storm
Drain project .
That immediate- area ( and again, OUTSIDE of the proposed
development area) has been designated Zone A (General Flood
Plain) on the U. S . Army Corps of Engineers Flood insurance
Raze Map ( FIRM) . Because of this designation, a flood study
would be reouired for this area should there be any further
subdivision affecting this area. The balance of the property
of which the proposed development is to be situated , has been
classified as Zone C , areas of minimal flood hazard problem.
To account for this situation, the applicant will work
with the County in arriving at an drainage system that
provides the required drainage protection for the proposed
development area.
UTILITIES AND SERVICES
1 Roadways
Primary access to the property will be through a fifty
( 50)-foot wide roadway from Kupulau Street and interior roads
constructed to County dedicable standards. Eventually ,
alternate access to the other portion of the property may be
made available through the Haihai Street extension.
Kupulau Street has a right-of-way width of forty (40)
feet with an existing pavement width of twenty ( 20) feet .
The Zoning Map calls for an eventual right-of-way of eighty
( 80) feet. The Haihai Street extension is a fifty ( 50) foot
wide road reserve running along the southern boundary of the
property. There are no improvements within this road
reserve and none are planned for as part of the proposed
subdivision.

Water is available to the subject property from existing
transmission facilities along Kutulau Street . There is aT:

This area is not served by a municipal sewer system.
Domestic waste disposal will be handled through the use of
cesspools . constructed in accordance with State Department of

Police/Fire
These services are available to the subject site. There
is a fire station on Kawailani Street , approximately 3 1/2
miles away . The main Hilo police station is located
approximately 5 miles from the property.
JUSTIFICATIONS FOR STATE LAND USE URBAN DISTRICT REQUEST
Subsection 15-15-18 of. the Land Use Commission ' s rules
identifies standards for determining the characteristics and
boundaries of an Urban district . Many of these standards
also coincide with the County' s criteria for determining
rezoning which will be covered later in this joint request .
The property falls within the immediate outskirts of an
area characterized by "city like" concentrations of people .
As such, it is a parcel away on the makai side from an Urban
district. In a land use sense , it will be an extension of
the existing upper Waiakea Homesteads residential subdivision
development which presently contains residential lots from
10 , 000 square feet to one-acre in size.
In the immediate vicinity of the subject property, there
are parks , gyms and other recreational facilities , as well as
small-scale , neighborhood commercial facilities . Schools are
also situated close by along with other public service
facilties .
Being on the fringe of this growing residential urban
community , the subject property will not contribute to
" scatterization" of the established land use pattern, nor
will its inclusion into the Urban district result in the
expansion of governmental services or facilities .

Conformity to the General Plan LUPAG Map
The subject area is presently designated for Extensive
Agriculture and Alternate Urban Expansion. Under these
designations , thedevelopment and proposed development requested zoning
could be favorably considered.
The Alternate Urban Expansion designation allows for a
variety of urban-type uses where new settlement patterns may

be desirable but where these settlements and specific use
patterns have not yet been established. In the subject area ,
the use patterns have been generally established by the
adjacent Waiakea Homesteads subdivisons as an urbanczed , low
density residential area. The makai side of Kupulau Street
is characterized by lower density residential lots and
residences , while the adjacent Kahalani Estates to the
northeast contain similar one-acre, agricultural/residential
sized lots. It is
proximate to centers of employment ,
schools , and other public service facilities , and the mixture
of residential and agricultural zonings are consistent with
the character of the area.
This proposed development would also provide a range of
various lot size choices for potential residents , from
typical residential type lots , to the larger , more spacious
agricultural lots along the mauka portion of this general
area where active and quasi-agricultural activities could
still be pursued.
Compatibility with Surrounding Area
The proposed development will be compatible with the
surrounding land area. As stated above , the makai side of
Kupulau Street is characterized by lower density residential
subdivisions , while the ajacent Kahalani Estates to the

through anthurium blight. Furthermore , the applicant intends

primary plant located in another sector of 'Hiic .
Large scale , intensive = agricultural activities appear to

be somewhat limited in thiarea, as evidenced by the absence •

of agricultural activities in the immediate-.and„ generally
surrounding area.. Therefore , this reclassificaion anc
rezoning actions do not appear. to jeopardize - the agricultural
resources of the area and the County.

County ' s grading-.and- arainage requirements Will be adhered to
to minimize -any drainage impacts within the proposed
development area.

The property is readily accessible to an area that' has

GENERAL BACKGROUND
The applicant , Orchid Gardens , Inc. , is proposing to
create a residential subdivision consisting of thirty five
(35) lots with a minimum lot size of fifteen thousand
(15 ,000) square feet at Waiakea Homesteads, 2nd Series , South
Hilo, Hawaii , TMK: 2-4-65 : portion of 2.
In that regard, the applicant is requesting that a
portion of the 39 .146 acre property be reclassified from the
State Land Use Agriculture to the Urban district. The
requested area is 13. 74± acres.
Simultaneous with the State Land Use boundary amendment, .
the applicant is seeking to have the proposed Urban area be
rezoned from the County' s Agriculture (A-10a) zone district
to the Single-Family residential (RS-15) district. The
balance of the property (25 .406+ acres) would remain in the
State Land Use Agricultural district and the County
Agriculture (A-10a) zoned district.
PROJECT LOCATION
The property is an interior lot consisting of 39 .146
acres situated mauka or west of Kupulau Street and abutting
the proposed Haihai Street extension. Access tothe property
is through a 50-foot right-of-way originating from Kupulau
Street. Although theproperty abuts the proposed Haihai
Street extension, no access from this proposed street is
planned.
Lands surrounding the parcel are generally vacant and
undeveloped. The makai side of Kupulau Street is
characterized by single-family residences with lot sizes
ranging from 10,000 to 15 ,000 square feet. The area to the
northeast is zoned for one - acre agricultural lots and
contains a 26-lot subdivision referred to as the Kahalani
Estates Subdivision. The balance of the surrounding area is
presently vacant and used primarily for cattle grazing and
drainage purposes . It should be noted, however, that there
was a one-acre rezoning application for that area between the
subject property and Kupulau Street that was recently
withdrawn.

PROJECT DESCRIPTION
•
The applicant intends to subdivide the northern end of .
the property into thirty-five (35 ) 15 ,000 square-foot
I. residential sized lots. The remaining 25 .4+ acre portion of
the property would be left in its present limited state . The
undeveloped portion has two saran shade structures where the
applicant is raising anthuriums. The applicant ' s long-term
goal is to gradually phase this area out and consolidate his
operations at his present site along E. Kawilani Street.
The proposed subdivision. will be fully improved with
County standard roadways, water system, and utilities. The
applicant hopes to market the lots at about $35 ,000 based
upon. 1987 dollars. A low density residential ambience,
consistent with the surrounding area (such as the Kahalani
Estates) is being sought by this development.
INSTITUTIONAL CONSIDERATIONS
State Land Use
The present designation of the subject property is
Agriculture. The lands immediately surrounding this property
are also situated within the Agricultural District, except
• for that portion makai of Kupulau Street. .
The proposed redesignation may be considered pursuant to
Planning Commission Rule No. 13, State Land Use District
Boundary Amendments , whereby the Planning Commission is
authorized to redesignate properties with land areas of 15
acres or less:
County General Plan
The General Plan Land Use Pattern Allocation Guide
(LUPAG) Map designates this area for Extensive Agriculture
overlain by Alternate .Urban Expansion. As such, thisrequest
would not be contrary to the General Plan LUPAG map.
Zoning Code
The County Zoning for the subject property is A-10a.
This zoning designation allows minimum building sites of at
least 10 acres in size. Permitted uses include single-family
► . dwellings (one per building site) , all forms of agriculture
1 uses, home occupations , golf ,courses , parks and similar .
recreational uses , aquaculture, hunting and fishing lodges ,
guest ranches, and accessory uses .

ENVIRONMENTAL CONSIDERATIONS
Site Characteristics
A portion of the subject property isdeveloped for
anthurium production. Two separate saran shade structures
covering four (4) acres each were constructed in 1981-82 ,
along with a 10-foot wide rough graded access road to connect
the parcel unto Kupulau Street. The remainder of the parcel

is vacant and unimproved.
As noted previously, the area of the proposed
residential subdivision does not affect the existing
anthurium operations/structures . Those structures and
activities are located south of the proposed subdivision.
The topography of the site is fairly level and the
average rainfall is over 100 inches annually.
According to the U. S. Department of Agriculture Soil
Survey Report , soils on the property are primarily of the
pahoehoe variety with pockets of organic matter. • These would
be shallow pahoehoe, moderately drained, with an average
slope of 0-35 percent .
There is also some pockets of the Olaa Soil Series .
This series is characterized by extremely stoney silty clay
loam (O1D) series. They are well drained, silty clay loams
that formed in volcanic ash. These soils are primarily used
for sugarcane cultivation. However, the natural and existing
vegetation consists of guava, ferns, and "Hilo" grass.
According to the Agricultural Lands of Importance to the
State of Hawaii (ALISH) classification system, the proposed
development area does not appear to be classified.
According to the Land Study Bureau Overall Productivity
Ratings system, the area of the proposed development has a
Class E rating. It does appear, however, that there is a
Class C rating over a minute portion of the makai section of
the proposed development.
Vegetation/Fauna
The undeveloped portion of the property contains native
vegetation such as guava, "Hilo" grass , and other
miscellaneous grasses and shrubs. There are no significant
trees or other vegetative features on the property.
Common animal species in the area include field mice ,
mongoose , and stray domestic animals such as cats or dogs .
Occassional cattle and horses are sometimes allowed to graze
on portions of the property.

There are no known or recorded rare or endangered animal
• or plant life in the area.
Archaeological Features
There is no evidence of historical or cultural features
on the parcel, nor did the records at the County Planning
Department uncover any significant findings attributable to
the area or subject property.
Drainage
That portion along the southern edge of the property
(but outside of the proposed development area) is encumbered
by an 80-foot wide drainage easement in behalf of the County
of Hawaii . This drainageway is part of the Waiakea-Uka Storm
Drain project.
That immediate area (and again, OUTSIDE of the proposed
development area) has been designated Zone A (General Flood
Plain) on the U.S. Army Corps of Engineers Flood Insurance
Rate Map (FIRM) . Because of this designation, a flood study
would be required for this area should there be any further • •
subdivision affectingthis area.. The balance of the property
of which the proposed development is to be situated, has been
classified as Zone C, areas of minimal flood hazard problem.
To account for this situation, the applicant will work
with the County in arriving at an drainage system that
provides the required drainage protection for the proposed
development area.
UTILITIES AND SERVICES
Roadways
Primary access tothe property will be through a fifty
(50)-foot wide roadway from Kupulau Street and interior roads
constructed to County dedicable standards . Eventually,
alternate access to the other portion of the property may be
made available through the Haihai Street extension.
Kupulau Street has a right-of-way width of forty (40)
feet with an existing pavement width of twenty (20) feet.
The Zoning Map calls for an eventual right-of-way of eighty
(80) feet. The Haihai Street extension is a fifty ( 50) foot
wide road reserve running along the southern boundary of the
property. There are no improvements within this road
reserve and none are planned for as part of the proposed
subdivision. -

Water
Water is available to the subject property from existing
transmission facilities along Kupulau Street . There is an
8-inch water line along Kupulau Street .
Sewer
This area is not served by a municipal sewer system.
Domestic waste disposal will be handled through the use of .
cesspools , constructed in accordance with State Department of
Health regulations.
Tel hone/Electricity
Both telephone and electrical service can be made
available to the property.
Police Fire
These services are available to the subject site. There
is a fire station on Kawailani Street , approximately 3 1/2

miles away . The main Hilo police station is located •
approximately 5 miles from the property.
JUSTIFICATIONS FOR STATE LAND USE URBAN DISTRICT 'REQUEST
Subsection 15-15-18 of the Land Use Commission' s rules
identifies standards for determining the characteristics and
boundaries of an Urban district. Many of these standards
also coincide with the County' s criteria for determining
rezoning which will be covered later in this joint request.
The property falls within the immediate outskirts of an
area characterized by "city like" concentrations of people.
As such, it is a parcel away on the makai side from an Urban
district . In a land use sense, it will be an extension of
the existing upper Waiakea Homesteads residential subdivision
developmentwhich presently contains residential lots from
10,000 square feet to one-acre in size.
In the immediate vicinity of the subject property, th€re
are parks,' gyms and other recreational facilities , as well as
small-scale , neighborhood commercial facilities. Schools are
also situated close by along with other public service
facilties.
Being on the fringe of this growing residential urban
community, the subject property will not contribute to
"scatterization" of the established land use pattern, nor
will its inclusion into the Urban district result in the
expansion of governmental services or facilities.
Infrastructure to service this project is already in place

and/or can readily be made available to the property by the
applicant . It is also readily accessible through existing,
County standard roadways.
Finally, there are no significant developmental
constraints on the property such as flooding, excessive
slopes , or unstable ground/soil conditions which cannot be
adequately mitigated.
The proposed redesignation is also permissible under
Planning Commission Rule No . 13, State Land Use District •
Boundary Amendments , whereby properties with land area of 15
acres or less may be considered for a change of designation
by the County Planning Commission., with subsequent decision
by the County Council.
JUSTIFICATIONS FOR THE REZONING REQUEST
. Conformity to the- General Plan LUP.AG Mai
The subject area is presently designated for Extensive
Agriculture and Alternate Urban Expansion. Under these
designations , the proposed development and requested zoning
could be favorably considered.
The Alternate Urban Expansion designation allows for a
variety of urban-type uses where new settlement patterns may
be desirable but where these settlements and specific use
patterns have not yet been established. In the subject area,
the use patterns have been generally established by the
adjacent Waiakea Homesteads subdivisons as an urbanized, low
density residential area. The makai side of Kupulau Street
is characterized by lower density residential lots and
residences, while the adjacent Kahalani Estates to the
northeast contain similar one-acre, agricultural/residential
sized lots. It is proximate to centers of employment,
schools , and other public service facilities , and the mixture
of residential and agricultural zonings are consistent with
the character of the area.
This proposed development would also provide a range of
various lot size choices for potential residents, from
typical residential type lots, to the larger, more spacious
agricultural lots along the mauka portion of this general
area where active and quasi-agricultural activities could
still be pursued.
Compatibility with Surrounding Area
The proposed development will be compatible with the
surrounding land area. As stated above, the makai side of
• Kupulau Street is characterized by lower density residential
subdivisions , while the ajacent Kahalani Estates to the

northeast contain one-acre , agricultural/residential sized
• lots . The proposed mixture of residential and agricultural
zonings are consistent with the general character of the
area, and the proposed development will also share existing
urban type improvements and characteristics which are already
in place such as utility services , street lights , and public
facilities.
A ricultural Impact
At present , approximately 4 acres of the entire property
are currently being used for foliage production. The balance
of the property (which includes the proposed 13'. 7± acre area)
is vacant of any active agricultural activities._ It is
vacant and used periodically . for limited cattle grazing.
applicant ' s
should also be noted that prior to the
foliage operation on the four acre portion, the entire
39-acre parcel was used only for limited grazing purposes . •
There is no history of previous clearing for cultivation or
similar extensive types of agriculture.
The foliage production operation in this area has become •
marginal due to extensive deterioration of the plantings
through anthurium blight. Furthermore, the applicant intends
to phase this area out and concentrate his operation at his
primary plant located in another sector of Hilo. '
Large scale , intensive agricultural activities appear to
be somewhat limited in this area, as evidenced by the absence
of agriculturalactivities inthe immediate and generally
surrounding area. Therefore, 'this reclassification and
rezoning actions do not appear to jeopardize the agricultural
resources of the area and the County.
No On-Site Development Issues
The subject property has no history of archaeological ,
or habitat constraints, nor are there any topographic
limitations which affect the development of the proposed
subdivision.
Potential drainage impacts have been identified for this
parcel , but in an area that is NOT subject of this proposed
development/petition. Furthermore, compliance with the
County' s grading and drainage requirements will be adhered to
to minimize any drainage impacts within the proposed
development area.
No Significant Infrastructural Burdens
The property is readily accessible to an area that has
all existing infrastructure in place. Roadways , public
services , and other facilities are available to the property

and are not anticipated to be unreasonably burdened as a
result of granting this rezoning.
In light of the foregoing, it is submitted that this
request is reasonable. It will not cause any significantly
adverse agricultural impact; it does not have on-site
development constraints ; it will not overly burden public 0
services and facilities; and finally, it will help address
the overall housing needs of this area by adding inventory to
the number of available lots.

Your Committee on Planning, to which was referred Bill No . 645,
regarding the rezoning request of Orchid Gardens, Waiakea Homesteads ,
South Hilo, Hawaii, TMK: 2-4-65 :Portion of 2, reports as follows:
Bill No . 645 amends Section 25-114, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
13.74 acres of land from Agricultural (A-10a ) to Single Family
Residential (RS-15 ) .
The applicant is seeking to simultaneously reclassify the State Land
Use and zoning designations of the subject property.
The applicant plans to develop a 35-lot residential subdivision
PP
consisting of 15,000 square foot lots . The applicant stated that he
does not have any plans to build dwelling units on the lots, which
willsell for approximately $35,000 each.
The General Plan designates the property for Orchard use and
Alternate Urban Expansion. Water and other essential utilities and
services are readily available to the property.
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 645 and recommends that it pass first reading.

Bill No . 646 amends the State Land Use Boundaries Map, H-66, of the
County of Hawaii , by changing the district classification of
13.74 acres of land from Agricultural to Urban .
The Waiakea Homesteads area, where the subject property is located ,
is situated in close proximity to major employment and government
centers of our County. As such, it complements the Land Use
Commission Rules which states that, in determining the boundaries for
Urban District, "It shall include lands characterized by 'city-like '
concentration of people, structures , streets, urban level of services
and other related land uses . "
•
While the property is currently within the State Land Use
Agricultural district, it is notactively used for agricultural
purposes. The property was used for very limited grazing activity.
Therefore, the Department of Agriculture has stated that
reclassification action will not adversely affect the agricultural
resources of the area.
Water and other essential utilities and services are readily
available to the property .
Your Committee on Planning is in accord with the intent and purpose
of Bill No . 646 and recommends that it pass first reading.
